Where to get the legal Capacity to Contract Marriage

I am getting married in Davao next week.

I was in Colombia where I went on the US EM in Manila website and book the appointment for "Lieu of Certificate of Legal Capacity to Marry" which I got on my way back to PI in 2 hours at the most.

Then, I went to Davao CNOMAR (Spelling?) and got the marriage licence. They attached the US EM legal capacity doc to the it.

Then I went to the Hall of Justice here in Davao and did their raffle.

Sofar, nothing got rejected!

Should be getting married next week.

I am doing this to do the DCF. It's much fast than if it's don't here than in the US. It bypasses the USCIS and all is done at the US EM.

Yes, thank you. My worry is whether it will be rejected by the local registrar in Davao city.

I'd like to share what my experience and I hope it helps you.

I have to warn you first. I got the required affidavit and my fiancee and I have tried to apply for marriage license. We failed as they did NOT accept the affidavit. Not only local registrar but also local NSO office (in Tandag) didn't accept our affidavit. Simply they said they can't trust it as it's NOT a certificate. I basically wasted 3 weeks of my annual leave and we had to do a engagement ceremony and we decided to do a K1 path instead after failing to secure marriage license. Well you might say, there must be 1000s of couples whose fiance(e) are from US and how could they get married??? It really depends on where you apply for the license and it also varies person to person who accepts your application. Even the same city can have a different outcome.

You can definitely can try but if you want to go safe route, don't waste your 3 weeks of annual leave days. Besides k1 will allows you to get together much faster. I'm actually happy that my application got rejected although I wasted my bloody hard-earned annual leaves.

The U.S. Embassy Manila can issue only an "Affidavit in Lieu of Certificate of Legal Capacity to Marry," not a "Legal Capacity to Marry."

US consulate office in Cebu also issues that. I got it from Cebu in June.

If Davao City won't accept it, just get married in another city. My wife and I were able to get married in Kapalong, Davao del Norte just fine with the Affidavit in Lieu of Certificate of Legal Capacity to Marry.

You could also paper clip a P500 'filing fee' when you submit your paperwork to the clerk at the LCR. If they raise any questions just say that a friend told you there was a fee to process. Always helps to smooth the path.

Just sayin'. Helped me get a 16KG carry on onto the plane at NAIA.

A citizen of the United States may execute this affidavit at the American Embassy in Manila or the Consular Agency in Cebu.The American Embassy is located at 1201 Roxas Boulevard, Manila, telephone(63) (2) 521-7116. The Embassy is open Monday thru Friday (except Philippine and American holidays) from 7:20 A.M. to 11:30 A.M. and from 1:00 P.M. to 3:00 P.M.  Americans may also obtain this affidavit at the U.S. Consular Agency in Cebu, 3rd Floor, PCI Bank Bldg., Gorordo Avenue, Lahug, Cebu City - tel.
