I may have really done it this time. Anyone who might know what to do, please advise...

My fiancee came here on a K1 visa. We married within the 90 days and did our applications. She was fingerprinted and received her employment authorization card. The first week in January we received a letter dated December 10th for her interview date of January 16th. The letter looked as if it had been around the world twice. She had a family emergency ( her mother fell ill and was not expected to live) and left the country two days later, WITHOUT advance parole. I tried to contact USCIS no less than four times in the next few days and attempted to reschedule. The answer I received was different every time, but at least twice I was told not to worry, I could call to reschedule at any time (did not sound right to me either..). Next I received a letter saying her advance parole was cancelled because they had "evidence she was travelling outside the USA without authorization". Next I received another letter stating that since she missed the interview, our application to adjust status had been cancelled. I could, however, request that the case be reopened by sending a letter stating a valid reason for missing the interview along with a payment of $630.

Am I wasting my time here? I feel as if I am trapped in a situation with no way to resolve it. I love my wife dearly and I want her to be able to return. I don't even know where to send the letter and $630 to. AND, I don't even see how she can return without advance parole. Anyone have any ideas? Many thanks in advance...

I'm sorry about your wife and her mother, and the problems that came out of this. This is a tough situation indeed.

I suggest that you get all the documents and proof that you need, and file an appeal. You may even have to contact your congressman for some help here. Cite not just emergency of the situation when she had to leave the country right away, but also for humanitarian reasons.

2010/07/27 - Check cleared

2010/08/21 - 3rd Call to USCIS call center, finally got our Case #, still no mail

2010/09/01 - NOA1 official date

2010/09/07 - NOA1 received, FINALLY!!!

2010/10/06 - Touched (expedite request callback from USCIS, giving us the requirements)

2010/10/07 - Finally got the papers from the doctor and submitted requirements for expedite

2010/10/07 - Touched with callback

2010/10/14 - USCIS website says it's APPROVED!!! mailed

2010/10/19 - received at NVC

2010/10/21 - NVC sent documents to the US Embassy in Manila

2010/10/23 - 2nd Visit the the Phils, touchdown in Manila & flight to Samar, Pamamanhikan for brunch, Engagement Party for dinner

2010/10/24 - Picnic with close family and friends

2010/10/25 - Engagement Party with family in Manila

2010/10/26 - Leave the Phils back to the US

2010/11/22 - Interview at the US Embassy in Manila - VISA APPROVED!!!

2010/12/30 - POE in Las Vegas. TOGETHER AT LAST!

2011/03/06 - Married in Las Vegas

2011/05/03 - AOS, EAD & AP filing date

2011/05/11 - NOA1 for all

2011/05/24 - successful walk-in biometrics (originally 6/10)

2011/06/20 - got online status update and hardcopy of interview appointment dated 6/16 but scheduled for 7/26

2011/07/22 - AP approved, EAD card in production

2011/07/26 - AOS interview. RFE coz they LOST MY MEDICAL!!! GRRR!

2011/07/30 - EAD/AP combo card in the mail

2011/10/21 - finally got my GREENCARD after several complaints all over the place

OP, you may end up having to go back to square one and file an I-130 to start the spousal visa process.

August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

after reading your prior posts,

it seems that you filed an I-130 + I-485 because you did NOT marry within the 90 day window on that K-1.

That's a plus, actually. Check into the status on the I-130 with a telephone call into USCIS, and then if it's already approved,

you need to get a Tier 2 human, an ISO, to get the approved I-130 sent off to NVC.

Once it's at NVC, enroll in the OPTIONAL ELECTRONIC PROCESSING for Guangzhou, handle the I-864 and DS-230 there, and get an interview.

IMO, if that I-130 IS ACTUALLY approved, all of the above is possible and can be handled within 4 months.

If the I-130 was not approved, then file a new one to the lockbox, clearly noting that your chasing after Consular Processing Abroad in Guangzhou on the I-130.

as far as re-opening the current case, it's not useful - as she's not in the USA currently and doesn't qualify for AOS (to the best of my knowledge) ..

No point in appealing because she left without AP, so there is nothing to appeal, they made the correct decision.

Agree with Darnell. Did you file a I-130 with the I-485 or no?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Was it a dual purpose EAD/AP card, or did you not even file for AP? You say you "did your applications" which isn't real specific.

Filling out your timeline would really be helpful...I don't see the other posts Darnell is talking about.
