Criminal Record Stress

So,

I'm confused and scared do file my N-400. I had a previous criminal record from my home country. All Charges are well over 10 years old. Obviously it hasn't affect my immigration process so far.

Now, since I've lived here heres whats happened:

my wife who I am still married to (separated and living apart for 1.5 years) ran up $15,000 in toll fines on a vehicle registered in my name. they charged me with 3 class c misdemeanors for failure to pay toll. I went to court, they said if I paid $1100 they would drop 2 of them and I plead no contest to the third. Now, this was submitted with my green card application to remove conditions. I included a signed letter from my wife stating she was responsible for the fines. Again, wasn't an issue.

I was arrested (wrongfully I will say) for public intoxication and its a class C misdemeanor, went to jail for 6 hours and was released. Went to court instead of paying the fine. Case was dismissed.

now my questions.

do i still need to worry about the criminal stuff from my home country? or are they just going off the 5 years you've been in the US? Also I will be sending photocopies of my Canadian court records for the third time since you have to go to the court house to get them. Which isnt an option for me. Im debating not sending the canadian stuff since they have a few copies already and if they question it I will tell them they have the only copy I have already.

Basically I dont wanna apply and run the risk of being denied or at worst deported. I have a five year old son whom Im extremely close to and lives with me half of the month.

hopefully this all makes sense to someone.

I'm pretty sure you need to include ALL your background criminal documents, regardless of how long ago they were from. I do know that even if you've submitted them to USCIS in the past (for your initial interview and your subsequent removal of conditions) you STILL need to submit them again for naturalization and in the actual N-400 instructions is says: "...if you have been arrested or convicted of a crime, you must send a certified copy of the arrest report, court deposition, sentencing and any other relevant documents...."

I personally don't think your application will go far without the items USCIS outlines in their guide.

Good luck!

they already have them. Ive sent photocopies the last two times because getting certified ones is impossible. Ill be damned if im going from Texas to a little town in canada for a sheet of paper. plus having to get a passport. yeah right. Ill just send photocopies of the certified ones again and go from there.

I mean ive got pretty far so far with out certified copies.

and yes Ive read the instructions.

thanks champ.
