The deal:

Married for over 25years, swedish wife, american husband.

USC will leave Europe for US in may and is now filling out the I-130, but not yet sent it in. Wife wants the least time to be apart.

Can the wife enter the US on a tourist (90days) and apply the I-130 when in the country or must it be from outside?

After I-130 we file the I-485.

9/17: NOA

9/19: Check cashed

9/23: Received NOA

10/7: Text from USCIS on status update: Biometrics in the mail

10/9: Received Biometrics letter

10/29: Biometrics

10/31: In-line

2/16: Text from USCIS that Baltimore has scheduled an interview...finally!!

2/24: Interview letter received

3/24: Naturalization interview

No. She cannot move to the USA with the intent to immigrate. What you are suggesting is not legal. If she told the POE officer that she was planning on staying in the USA, they would deny her entry. That would mean she would have to lie to get in, which is fraud and will result in a ban.

I suggest filing the I-130 while overseas. That way the petition is never sent to a local office (do not use a US address.) Stay together until you move. You will have to show that you are reestablishing domicile so you may have to move ahead of time to get a home ready. If you do not have a US income currently and will not have a job by the time the I-864 is required, you will need a joint sponsor.

This is correct, your wife cannot enter the US with the intent to immigrate and adjust status, it is illegal and can result in a denial and ban with no chance for appeal. There is DCF in Sweden, that would be the quickest way for her. Follow the guides at the top of the page. Here is a link to someone who did DCF through Sweden, perhaps it can give you some insight. File now, have her visit with the visa waiver a couple of times during the process.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

But filing from abroad (using a foreign address) will probably go a lot faster than filing from within the US.

That's strange since NOLA just had her DCF interview there today............

They didn't technically DCF through Sweden. Look at their 'about me' tab on their profile. Their case is unique and very complicated.

No, I know all that, but when she went on about it, I thought that's where they had to go because that's the embassy that had the IV unit that "ruled" over denmark.

Technically, they did DCF, but through London (which does have an international field office), yet interviewed in Sweden. Like I said, looking at their timeline, it's complicated laughing.gif
