I-485 Application - Received request for Initial Evidence - Question on it

Hi All

My wife and I are currently in the process for my AOS.

When we filed the I-485 we filed the paperwork with the following:

TABLE OF CONTENTS:

1. G-1145 E-Notification

2. Table of Contents page

3. I-485 Adjustment of Status Application

4. I-485 Continuation sheet

5. Copy of Passport Stamps, Biographical page, and Visa page

6. Copy of NOA2 Approval for I-129F

7. Copy of I-94

8. Certified copy of Birth Certificate

9. Certified copy of Marriage Certificate

10. G-325A

11. G-325A Continuation sheet

12. Passport photos

13. I-864 Affidavit of Support (Joint Sponsor)

14. I-765 Application for Employment Authorization

We have received a Request for Initial Evidence, they are asking for the following:

1. FORM I-864 was submitted; however it was not from the petitioner / sponsor

2. Submit evidence of the Joint sponsors status (US Citizenship)

Now I am assuming that as my wife did not submit an I-864 for my AOS the first part of the request is for her to file an I-864? or should I file an I-864 based upon what I have in savings?

Now I am assuming that as my wife did not submit an I-864 for my AOS the first part of the request is for her to file an I-864? or should I file an I-864 based upon what I have in savings?

If you have a joint sponsor - the US petitioner/ spouse of the immigrant is still required to send the affidavit of support forms in regardless because they are the primary sponsor through the whole process even if they have no income.

So yes if she did not send the 864 sheet then she needs to send one with the supporting documents. So if she has no income and did not file taxes then she would need to send the proof of not having to file taxes. Or if her taxes were too low to sponsor she needs to send her tax return/transcrips with the forms.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Be sure that you include a copy of the BC or the biographic page of passport for the js to prove US Citizenship. I only included it for the sponsor and not the joint sponsor and received an rfe because of that. just a slight oversight.
