I-485 Part 3 for F1 Canadian student

Hi everyone.

I am a Canadian married to a USC and am filing for AOS from F1 as a Canadian student. On form I-485 Part 3 it asks for the consulate where the visa was issued. I received an I-20 by mail, and not a traditional visa as a Canadian student, so do I just put N/A?

Also, it asks for my "non-immigrant visa number". As a Canadian my I-94 just has an 11 digit admission/departure number, and lists my F1 status followed by "D/S" or duration of stay. What do I put as the non-immigrant visa number"? Should I put my I-20 SEVIS number?

Any thoughts would be much appreciated. This community is a wonderful thing!

Didn't you have an F1 visa (a physical visa in your passport) when you entered?

Thanks for taking interest "newacct".

No, as a Canadian on an F1 I presented my SEVIS form at the border - which is an I-20 form. Canadian students do not receive the typical visa because there is no consular interview or anything. Since then (initial POE Aug 2009) I believe I may have been asked for my I-20 once upon my travels back and forth. Usually they just see my I-94 which says "F-1 D/S".

Any ideas? Should I try to move this question to a Canada regional forum?

thanks,

You put N/A. Your SEVIS number is NOT your visa number. You do not have a visa number.

Canadians can apply for F-1 status at the border. They do to have to go to the consulate and get a real visa, they can get the status and a I-94 at the border crossing.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

I'm sorry to resurrect an old thread.

I'm having the same problem and was wondering what you selected for part 2 of form I-485? I don't seem to qualify for any of the application type.

Any help would be greatly appreciated.

In part 2, I selected 2a "An immigrant petition giving me an immediately available immigrant visa number that has been approved. (Attach a copy of the approval notice, or a relative, special immigrant juvenile, or special immigrant military visa petition filed with this application that will give you an immediately available visa number, if approved.)"

If you came here on an F-1 student visa from Canada and married to a USC, you have an immigrant visa number immediately available to you. I sent them a copy of my I-94, I-20, and marriage certificate.

02/24: Sent in (I-130, I-485, I-765, I-131) to Chicago Lockbox via USPS Priority Mail

02/27: Delivered to Lockbox and Received
03/05: Checks for I-130 and I-485 cleared.
03/13: Received Biometrics notice for I-485 and I-765, scheduled for 03/25
03/25: Biometrics completed
04/16: email received stating interview is scheduled for May 19th

04/18: hardcopy of NOA Interview letter received for Cleveland, OH

05/06: EAD and AP approved

05/07: Combo card sent for production

05/12: EAD/AP notification that it was mailed

05/13: EAD/AP received in the mail

06/15: I-485/I-130 Approved, letter received on the 19th.

Great! Thank you so much for the information. So I should also send them my I-20?

Also I got several I-94's and I-20's during my studies, which ones should I send a copy of?

I sent them a copy of my most recent I-20.

You will bring the original to you GC interview and I was also advised to bring my old I-20's to the interview just incase the IO wants to see them. Hope this helps.

i believe that if you wish to return to canada or travel abroad anywhere in the time between applying and receiving your green card you also need to fill out a form i-131 (i-130 is what your spouse fills out) as well as form i-765 for employment authorization
