Hello VJ!

I was one of those unlucky folk who got bad advice when applying for AOS from a K-1 - I didn't bother filing for AP. I finally decided to file for AP Feb 19. I received the paper copy in the mail only about 3 weeks later! I was shocked!

Anyway, I've booked a trip to fly back to Canada next month. I just want to be prepared. My passport is still in my maiden name and the AP is in my married name. Should our marriage certificate be a good form of proof of the name change? I also have my EAD with married name which I will be taking with me. I plan to also take my NOA1 for pending AOS. Any other recommendations?

I applied for AOS less than a month after marriage and was married before my I-94 expired so I should be ok when it comes to overstaying.

You look good to go to me. When we crossed using my wife's AP (at Port Huron), they told us that all AP had to go through secondary, so allow extra time.

  • 4 weeks later...

I posted this topic last month and I've come up with another question. I travel to Canada for a short trip on Friday. When coming back to the U.S using the Advanced Parole for pending AOS, which customs card should I have filled out? The blue customs card or the I-94? Both?

Thanks everyone.

All people fill out a customs card (well, one per family). That tells customs what people are bringing into the US from outside.

With AP you will also fill out a I-94. That is an immigration record. Once you have a GC you will no longer fill out the I-94.

1 more question, I swear.

Does anyone know what name I use when filling out the I-94? The name on my passport (maiden name) or my new married name on the Advanced Parole document?

Thanks.

Hi Jianh. I am writing this from Canada as I am home for a visit using my Advance Parole. Since you are pending your AOS, you simply fill out form I-131 and send it in - along with a copy of your NOA1 and two US sized passport photos.

AP is free to apply for since you are awaiting AOS. It was covered in the $1070 cost you previously paid to USCIS.

Good luck! I received my AP about 3 weeks after I applied.
