Just to update:

I called their 1-800 number the week following the interview and they told me the interviewing officer approved my case but still pending supervisor approval. Fast-forward, 2 infopass appointments later until last friday, when I got a call in the morning from USCIS asking me to show up on 5/8 (yesterday) for the oath ceremony, thank God :) I'm now a happy US citizen,.

I am also in the same boat. I am getting very anxious. My interview on the whole went well but she put me on Decision cannot be made now. She did ask me if i am saying the truth today. Of course I am saying the truth.

120 days sounds like an eternity. Hopefully i should hear from them in over a month. I will wait for 2 weeks and then call them again if my status does not change.

My green card was through a I-751 waiver ( divorce )

Okalian, thanks for this.

Question: did you have to include your removal of conditions application for the N400? I mean, don't they already have that application with them? What other things should I include in my N400? I also do not have any moving violations and only a few parking tickets. The most was $110. All paid. The lawyer I spoke with said I did not have to include that in the N400.

I have my citizenship approval on hold because at the interview they saw my a green card was issued for 10 years but I never had to file to remove a conditional status . I never knew I had to remove a conditional status since they send me a 10 year card. I had my first interview in 2006 and my passport stamp said CR status pending. We waited and a year went by and I got no answer, the attorney send an inquiry and 7 month later they send me a letter saying it was approved and the green card was in there. It was for 10 years so I assumed they granted me the full status, not the conditional one since it was passed the 2 year marriage aniversary by 1 year and a half. Never assumed it was wrong but now at the citizenship interview they seem to think something is not right. The card was first time in my possession in 2008. It says on it I am a resident since February 2007 but only my got it in January 2008. Did they make a mistake by giving me a 10 years GC and now I am in a terrible situation because I never filed to remove any conditional status since I didn't think I had to as I was convinced I wasn't suppose to due to the 10 year card expiration? Never received anything else from them requiring me to file anything from the moment I got the card. Please advice if you had a similar situation.

I did not include the I-751 application with my N-400. USCIS already has a copy of that on hand. I kept my own copy to reference for information (mostly addresses I'd lived at during that period).

The most common things to include in the N-400 for a standard 5 year application:

  • Cover letter
  • Payment
  • 2 photographs
  • Copy of ID (green card, passport stamp and/or ID page, SSN card, driver's license)
  • Copy of 5 years' tax returns
  • Copy of divorce decree (if divorced)
  • Copy of marriage certificate (if newly married/name changing due to a marriage

Okalian, thanks for this.
