Hi everyone,

I arrived in the US last week on 12th March on a K1 visa. My POE was Chicago and the process was smooth with no problems. I married my fiance on 14th March and am in the process of preparing my AOS application. During my preparation when I was completing the various forms and in particular the field requesting my A number I referred to my NOA2 which contained the A number and when I compared it to my I-94 I noticed there was an error.

What appears to have happened is that one of the digits was entered as a 4 instead of a 5 on my printed K1 visa in my passport. The rest of the A number matches my NOA2. Whilst I checked my K1 that my personal details were correct it did not occur to me to check the A number. When I went through POE the immigration officer handwrote the A number from my K1 visa onto the back of the I-94 which is the number with the error.

I did some research on here and found that others with similar errors just submitted their AOS paperwork with the correct A number as issued by USCIS. This seems logical as I am not going to be able to be issued a new K1 visa now that I am here. So for now I have prepared all the forms with the correct A number and have included a supplemental page to go behind the copy I-94 explaining the error which I have duplicated for each of the 3 applications but I have not sent the packet off yet. I am concerned that I may not have been properly entered as having entered the US and want to avoid problems down the line so I would appreciate any advice from anyone who may have experience or information about this type of situation.

These are the enquiries I have made so far:

1. I called my local SSN office and explained the problem. I am still a few days from being able to apply for a SSN but I was basically told that once the 10 days are up then to bring all my paperwork down to the office including my original approval notice and they would see what they could do.

2. I contacted USCIS by telephone. They were pretty much useless. The only advice they gave me was to call US Border Protection. They wouldn't transfer me to a Tier 2.

3. I have tried to call US Border Protection all morning but the number is constantly engaged.

4. USCIS also told me to call the Department of State which I did but they told me to contact the Embassy in London. I don't see what they would be able to do so I haven't done that.

5. I have also made an infopass appointment for Wednesday but since the lady I spoke with from USCIS didn't have a clue what I should do then maybe this would be a waste of time too? My local office is a little over 2 hours away so I only want to make that trip it necessary.

Nick-Nick or anyone else do you have any ideas?

Are you far from your POE airport? Best would be to return there and have the CBP corrects your I-94, as it's their mistake and they are the ones issuing I-94.

Edit: Just noticed your A# on your visa is wrong too..

Yes, I am in Arkansas and the nearest POE is Dallas which is about 6 hours drive each way. I have a car which I share with my husband but it is old and I wouldn't want to take it that far by myself. I would have to rent a car plus pay for gas and a night in a motel so it would be an expensive trip. If that is the only option then I will do that but I would prefer to avoid the expense if possible.

POE wont be able to correct the I-94 if the number is wrong on the visa itself as well I don't think. Because POE cannot change a visa error, they don't have the authority. Only the issuing embassy can fix a visa error. Technically the I-94 is correct as it matches the visa but the number does not match your NOA2.

I'm wondering if contacting the embassy that issued it would be better to do now and ask them what to do concerning the error because the visa itself would need to be fixed but you have already used it. They may be able to issue you some type of statement about the error to include in your package or something though.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Noa2 is the correct one. Bottom line is, you might not be able to get a SSN based on the K-1 via, but you will be able to get one based on your EAD (that application is unrelated to visa/I-94 anything).

Worst case scenario, you lose a week waiting for SSN after your get your EAD.

This happens fairly often and most people don't even notice and survive. Good luck.

hit the cbp website, look for secondary or deferred inspection office. surely there is one somewhere in Arkansas?

can get it all fixed there, as 'what matters' is the entry in the SAVE database - and CBP has direct edit capability there. Don't bother to call, use telephone, for the fix - just go.

IMO, USCIS Infopass appointment will be useless.
