Hello everybody been a while for me being on here due to work! Got questions about some things..... we have the money now to file for the AOS. Just making sure i got it all right before i send it all in so I'm asking some question's to verify I'm on the right track. Ok question one is ..... I'm filing for my wife and my step daughter(8 yrs old)so would the cost be $985 for the K-1 I-485 and $85 for the bio. but does that include the fee for the I-765 EAD and for the I-131 AP? As for the K-2 the fee is $635 and does it include the fee for the I-131 as well? Is there any other fee's i need to know about when i send in the AOS packet? Second question they came in July of 2012 they both had all their medical before coming here the step daughter has had extra shots for school and is good till for 3 more years. Does my wife and/or my step daughter need to go to a civil doctor for any shots? Thanks

It is advisable to have another medical exam since it comprises of the medical examination, TB test (good for 6 months. Chest xray for 2 years) and RPR (blood test for syphilis) test. However, you still need to bring the shots record since it is part of the medical examination. If you need more instructions, please refer to I-693. If I am not mistaken, if you read the I-485 instructions, they need the sealed I-693 as part of your initial evidences documentation.

AOS from K-1:

AOS= $1,070 total (1 check). EAD and AP are free when filed with AOS. But from your timeline, your wife entered on July 20th of last year, which means her I-94 expired around mid-October, right? She is now past 5 months of "overstay" as she didn't file for AOS yet. It's not too much of a problem for AOS, but be aware that if she files for AP after 180 days of overstay, it will be very risky for her to use the AP.

Read page 5, point 3.A.5. of the I-131 instructions http://www.uscis.gov/files/form/i-131instr.pdf

So count 180 days past her I-94 expiration date, and hurry to file before that date (which should be sometimes in April). Once she files for AOS, she will be in a new period of authorized stay while her AOS is pending adjudication.

It's the same thing for your step-daughter.

K-1 Visa Timeline AOS Timeline

Yes both I-94 expired in Oct. but i had already filed for my wife's social security card when they first arrived but couldn't get one for my step daughter. Then tried to get back to changed the name on it to her married name which was before it expired now we have to wait till we get the AOS done before we can get her married name on the Social security card but she still has a number. Long story short I did this about 4 years ago for my first filipino wife (that didn't work out)and had to wait about a year before we could file for the AOS due to losing my job right before she got here but that was for her not adding a child like this time. Didn't have any trouble getting done then after a year because we went to the immigration office and asked the person there how long we had before we would be in trouble she said there's really no set time just do it as soon as you can but the rules may have changed since then? We are filing this week for the AOS,EAD and AP (even though were not planing to go back for another year) and have filled out all the forms was just making sure i was on the right track! One other thing do i go for the medical first or after i send all the forms in? will i receive some kind of notice? if there's something else i need to know please let me know and thanks for both of your responses.

Re-read my post, I said it's not a problem for AOS. You can file anytime because there's no deadline. There will would a problem for her AP if she files for it 180 days after the expiration of her I-94. It will be approved, but it would be very risky to use it. So hurry to file the whole package before those 180 days are up.

If your wife or daughter are missing any vaccines from her K-1 medical, they will have to have them done and have the civil surgeon fill in a I-693 Part I and the vaccination page of it. You need to do that before sending your whole package. If she's missing any vaccines and doesn't go to a civil surgeon to have the proper forms filled up before sending the package, she will receive a RFE.
