Hello,

I am confused understanding I-864 procedures.

My wife is a dependent on her parents. She is 24 but listed as a dependent on the income tax return and does not have other income.

She needs to file I-864 for me. This is for AOS application.

1. Does she need to attach her tax returns (her father's) as she is listed on there as a dependent?

2. Can she use the income stated on her father's tax return? I-854A would be used or not?

3. Can we use a Co-Sponsor? Like a third person not related to us? If yes then does he need to fill out I-864 separately?

Kind Regards,

Shakil

1. they are not her tax returns so no

2. only if he is going to be your co-sponsor

3. you can use any USC to be your co-sponsor and yes they would need to complete I-864 as well as your wife who will be your main sponsor..

1. She just needs to fill out a I-864 with no tax return or employment proof.

2. I thought I read on this site somewhere that a person can use household like parents income or something without the I-864A

3. If we have a USC be a co-sponsor, he just needs to fill out the same form which is I-864 or I-864A. What else would I need from the co-sponsor. A Job letter? Tax Returns?

Shakil,

Start by reading the instructions for the forms - your posts make it seem that you have not yet done this. (For one thing, you will not find the term 'Co-Sponsor' anywhere, but you will find a few other terms that are clearly defined and explained.)
