I-134 Affidavit of Support -- Am I able to show ability to support myself?

Hi! I'm new to these forums..

My fiance and I have some questions about financial evident of support. We are both working (and I am well-educated, plus have a decent employment history), and are wondering if I'm able to provide proof that I can support myself (as we prefer to keep our finances separate), and that I will have an adequate amount of savings to support myself prior to being able to work once I move to the US on the K-1 visa, and after we are married / I'm legally able to work. Is there an alternative to him having to show pay stubs or tax returns? Are bank deposits sufficient? Can I show he doesn't need to support me, and I can support myself? I'm just curious, and would appreciate any input / experiences with this.

Thanks :)

**Also: do they always request this I-134 form?

Since the K-1 visa is NOT an immigration visa, you cannot "support yourself" in the eyes of USCIS when applying for this. Either the petitioner or a co-sponsor must show enough income to be able to support you when you arrive. Remember, K-1 is a nonimmigrant visa for the purposes of getting married, so until you actually get here and get married and apply for Adjustment of Status, you are not legally allowed to work and your sponsor must be able to support you (even if it's not necessary) until you are able to work yourself.

Thanks for your quick response. :)

Will they for certain require pay stubs from him? How are the different ways he can show he can support me once I arrive?

Hi there,

Totally agree with both previous postings.

I understand your way of thinking, and they DO ask for the I-134, (they did for my interview) so it's best to have it filled out with 'supporting evidence'. We submitted/ had the last 3 years taxes as evidence, and that's all. But whatever is easiest for the USC I guess.

Later on, down the 'Visa Journey' road, you'll be filling out a similar form for your AOS (Adjustment Of Status); Form I-864/Affidavit of Support. On Part 7, of Form I-864, there are 'optional' questions, where you can put your financial information. As this was 'optional', I choose not to provide any of my information. After all , it's not required. (personal choice).

Any who, I hope this helps to shed some light on Form I-134. Better safe, then sorry.

Best of luck to you ,

&

Happy Journey

He MUST show tax returns (or proof why he was not required to file).

Paystubs are an easy way to prove income, but he can also show it via bank statements showing regular money coming in- or if he is self-employed, the tax returns only.

BTW, when it comes to AOS and later ROC, a major thing they want to see is co=mingling of finances; in their eyes, it shows that you trust eachother and are wiling to support eachother, and didn't just marry for the visa. So you may want to re-think your approach to keeping everything separate.
