Hi All,

My wife became USC last year and now we want to sponsor her mother. Question is, I live in Europe where I have taken employment and my wife resides with me. Can my wife fill-in I-30 for her mother while the sponsor (my wife) is outside U.S. We pay our portion of Federal income tax for the Foreign earned income exclusion. I've been researching around and so far haven't come across anything that says USC must applying for relative must be present in U.S when applying. Anything you share is appreciated. Thanks!

Doesn't need to be present when applying, but DOES need to show that they're moving back there. The i-130 is to reunite families. If you're not living in the US, then a visa/GC to the US doesn't reunite your family.

mimolicious, I'm wondering what makes you confident about being present in U.S at the time of interview? is it based on some experience by someone on VJ or you've read elsewhere. appreciate if you can post link.

It's not the time of interview, though it would make the interview easier; your wife simply must show proof she intends to move back at the same time or before the parents move.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
