This is why I'm on here, because I have yet to take her advice.

Well someone linked a CA program in the post above mine, so you can look into that and see if you qualify.

This sort of thing is negotiated with your job, but is usually nothing. Some nice jobs give you something as a father. Some bad jobs don't even give a new mom anything. My husband will get a week of paid from his work beyond his normal vacation time for having a new baby. One week, and I think that's lucky.

It's not the gov's business to pay people for choosing to have kids and take off from work. I mean, I think it is good to support people through this time, but there gets to be a point when it's like someone is getting paid to have a baby, and I don't think the gov should be in that business (too easily exploitable). You already will get tax breaks for the new addition, so that's something. Maybe CA has something, but there is certainly nothing on the federal level.

Look into that program and let us know what you discover.

I didn't receive any forms from my CPA, she just told me that I "should" be able to receive benefits, hence why I'm on here trying to find out more info about it.

so, when you get back with yer CPA - ask her 'how to do' then share with us here? TIA !

Agreed. However the Family Medical Leave Act (FMLA) provides for some things.

I dunno, if the CPA is suggesting it, what's keeping the OP from getting ALL Of the information from the CPA ? That seems to be the trick, for the moment, to coerce the CPA into giving over all of the information.

If I was the Dad to be, I'd be looking for more work, not less.

That's great. I'd actually like to get to know my daughter and bond with her. That's why FMLA exists, so fathers can do that. That's why i started this post, to see if green card holders are able to do this.

FMLA is for employees to take unpaid leave from work, you are looking for a handout from the state, completely different.

Providing is a great way of bonding.

Diapers and baby formula are expensive.

I am new father-to-be. I'm part-time employed so I'm not going to get anything from my work, but i have been allowed 6 weeks leave. I have no PTO, or any benefits as far as work goes...that's why I'm eager to find out what I might be able to get from the State of California as far as family leave time and/or disability payments?

Yes, I have full time employment, and I pay taxes to the state. (CASDI)

So which one is it, part time or full time?

It's already been explained to you that as a 5 year LPR if by chance you are eligible for any benefits, your wife would have to pay them back because of the affidavt of support she signed.

Stop looking for handouts and go provide for your family, that's what Fathers do.

That is a program run by the State of California which you may qualify for irrespective of your immigration status. FMLA is a federal law which provide for unpaid leave, but affects the entire nation. You may very well be able to take advantage of both programs.

Seriously - touch base with yer CPA again, get the scoop from her.

Federal and State programs are different, and yer CPA can explain all to you.

Sadly I'm considered Part time, but I work well over 40 hrs a week. That's a whole other problem I have to deal with at work.

So, what are benefits for? Why have them? Why am I paying tax into CASDI every week? For disabled people? Of course, but I'm not looking for handouts, I simply heard about a benefit for new fathers and I am looking into getting some answers. That's it. If nothing's available for me, fine, but if I'm eligible for something, obviously I'm gonna look into it.
