this is intented for new applicants. i was with my fiance when he received his packet 4 last week.

the letter they send has been revised. it no longer crosses out the i-134...its just not there anymore. and it also now includes that you need the celibacy certificate, court, and police certificates. whew!!! no more guessing!

also, it included the paperwork they wanted my fiance to fill out but included outdated versions. i downloaded versions online before i went to see him...and compared the two. the papers included in his packet were expired long ago! do they do this on purpose to give you problems? or do they still accept the old versions? i filled out the new versions for him anyway just to be sure but i found that odd.

just thought i'd update!

Good luck on the upcomng interview...I will be rooting for you two!

June 2005 - filed

October 2005 - visa interview

March 2006 - AOS packet mailed

DIVORCED

June 2007 - Interview

2008 - 10 year approval

hearing about all these denials are making me nervous. rida has interview 5/2. Jen, thanks for letting me know that forms they sent him are outdated. i will have to follow up on that and make sure he gets new ones. i can find them at the DOS site, right? i hope these two can get through the interview. at least they can keep each other company.

i really wish people would put why couples are denied so some people can see whats coming for them. like if they had a huge age gap or whatever big red flags... or what?! i saw the red flag thread and we have none of the above. but i still worry. you never know, right?

ps. yes, mona, im so glad our fiance's can keep each other company while they wait! :D

I think we have been posting why we "think" we were denied. Aren't there like 4-5 different threads? Actually, even though we are putting what we "think", 99.8% are not 100% sure......... besides, the very few things listed on visa journey probably dont even scratch the surface of what the "true list of red flags" could really be. Sometimes you just gotta take what you got!

The people that were just denied have more important things to do right now anyway! It's a whole new ball of wax. they have a lot of researchin to do, thank God alot of help is available thru a few special ladies on this site. (No need to say names u know who u are!) But it doesn't change the fact that they are about to emabark upon a totaly different type of "Visa Journey", and they will need time to make it easier for them. We cant tell u whats coming for you, we didn't even know it was coming for us! Come on now!

This is true, we had the age but according to everyone and legally that is discremination and was addressed all the way thru the application. We are not the first nor the last im sure to have the age matter. The person doing Ahmeds interview never even looked at ANY of the material i had sent in my neatly divided notebook, not one piece. She ask him one question if i had ever sent him money, which truthfully i had forget and there was no evidence at all to bring this up. Him being mr i always tell the truth, told her yes once. BUT then she never gave him the opportunity to say "but i returned it when she made the visit". Then she ask him "have you known other American women, again mr truthful, "yes i have had many friends i enjoy to talk my 3 languages with" the main word being HAD to him but maybe not to her.

So you see they piece the story together to fit their opinions only, they have nothing on us, because there is NOTHING to have on us, everything was right out in the open with nothing to hide. He felt the interview went very good, he has no background or reasons that HE should not qualify as a person to get the visa,and i dont see Casa as God to decide who should choose to be together in life, and all our papers were done very carefully with no problems accepted all the way down the line....so you tell me, why were we denied (age) again are we the first or last with this issue, (money) 1 time he paid back, has no one else done this, ive seen they even included the many receipts they have,(others) who on the computer doesnt have friends from all over the world?

Anyone going thru Casa should beware, you can do perfect papers and tell the truth and it wont matter one little bit, they do as the please. How many are married and they dont believe the marriages? i think they are putting themselves just a little bit to much to make the decisions into other peoples lives

Also IF we were given a reason for denial i would glady say, but we dont know either nor can we find out.

Jen, We do a lot of speculation here- but its like putting a puzzle together in the dark. From having been through the process with some bumps at the interview and coming out the otherside, from talking to others here,reading others here, from sharing experiences with immigrants- the best I can come up with is this-

I do not think any single red flag makes a denial. At Casa there seems to be some emphasis placed on time meeting or time together. Family in the US also can play a role. Age difference less so, but if in combination with other red flags then more so. I suspect the consulate has a policy in place that discusses fraud and discusses how they will show accountability that they are following this policy. Being identifies as a high fraud consulatte, it seems then that the consulate would need to "catch" fraud right? More and more it looks like a ####### shoot as to who gets caught up in the fraud sweep each month.

I think the odds of going through smoothlycould dramtically increase if you knew all of this stuff before filing. unfortunatley most of us come here only after we have filed. And proving to USCIS that you are qualified for this visa is a cakewalk compared to proving to the DOS ina high fraud consulate that your fiance/husband is qualified.

ETA: I am also in the school of thought around here that Casa marks certain applicants for possible fraud before the interview based ont he evidece in the orifinal petition for USCIS.

FIRST I have to say I am so sorry you are going through this. AND I think you are very brave to be so open especially during this time to post all of this. And I the following comments are just thoughts based on what you are saying for other women who will read this in the future - not a judgement on your relationship.

Okay so some of what Brnidokiegurl is saying seems to fit my post above. We all know the huge number of moroccan men on the internet to meet a woman and marry her. It's not enough to prove its not a legitimate relatinship as we all know many her on VJ who met ont he internet and were approved without a problem. Casa does seem to consider this when looking for fraud.

They asked my husband the same thing- does he talk to women on the internet. He didn't. He didn't even have an email and had to create one before I left Morocco the first time. He also couldn;t due to the nature of his job- always traveling. We had no chats on yahoo for this reason- so maybe the totality of all this satisfied the consulate. I'm just guessing.

I also see this last post from Brnidokiegurl as more evidence that they make a judgement before the interview that the case can be flagged for fraud. The questions then are asked to validate this and there seems to be very little chance of convincing them otherwise. I am still unconvienced that we were not suspected for fraud when Idir went in for the interview, but somehow- luck or Idir's handling of the interview- we managed to get through.

Am I reading too much into this based on my own experience or do others see the pattern I am seeing?

like Limah replied, those couples who were denied in casa were never told WHY. most of us only find out via our reps and then the reasons given are quite vague.

in our case we were told the reason given by the consulate was "due to the validity of the relationship". it is my guess (from those who have had their cases returned) that 99% of the denials there are for this reason.

in our case, the NOIR i received did not mention anything about what the CO found regarding our relationship.

it just stated a few laws in and that the consular findings that indicated my husband was not eligible for the benifit sought under immigration and that the relationship between us was not valid for immigration purposes. and that is it.

i just wanted you to know that we are not trying to hide anything, it is the consulate who is. i even went to Morocco begging them to let me show them the proof of our marriage that the CO failed to ask for at my husband's interview. if you read any of my posts, you may have a better idea of what happened in our case.

i understand your frustration and fear. none of us expected to get denied and have our cases returned to USCIS. there seems to be no rhyme or reason as to who they will select to do this too. the red flags posted are just a few of the possibilties that could be a reason. by no means it that list complete.

it has been said here to have you husband/fiancee prepared. he should feel comfortable with talking about your relationship. he needs to know every detail on the petition. he needs to know every detail that the CO has access to.

i am sure many will have advice for you. there is a thread for this as well.

i wish you well and i pray you get that visa!!!!
