I have seen many USC children residing in Jamaica, therefore I don't know where or how you are obtaining the information you are referencing. That's why I highly suggest you talk to a lawyer in Jamaica before you proceed any futhure.

Not even sure why you'll feel the adoption way is the only answer.

BTW have you and your child spent any long period of time in Jamaica outside of the normal vacation time?

Yes, I would double check your information. This "rule" seems prohibitive for anyone that wants to reunite with a spouse that has a kid. I would be willing to be adoption is not a requirement if you got married.

Thanks everyone for the advice, but after much discussion and constant brick walls we decided to go back to our original plan. We will persue to K1 visa. Have him live here until ROC is complete and then move back to JA when he has his 10 yr GC. Hopefully we will be able to save enough money in the mean time to make the transition easier when it comes to moving back... we also will have help from his family in that process so we should be ok. We will also be able to complete the adoption here during that time... Thanks again!!

I'd suggest you wait the extra year and move back after being naturalized and this way you don't have to go through the whole process again if you decide to move back to America.

Yes, a three year plan is what you will need. He can have dual citizenship as well.

I say follow the rules. Cutting corners will only cost you more in the long run. The K1 process from start to finish is 8-10 months. I say you fiancé can continue to work, six a month leave when visa is issued, then return after you resolve the adoption. You only filed in January so should give you time to save for expenses. It would be more heartbreaking if you decided too quickly with consideration all the ramifications.
