Hello,VJers

Last year, I had a k1 petition, that was returned to USCIS with recommendation to be revoked.

After over 9 months long waiting, couple days ago, I got the case status on USCIS’s website as follows:

Post Decision Activity

On March 08, 2013, the previous decision made on your case was revoked and we mailed you a notice explaining the decision. If you have not received the notice within 14 days of the date above, please call customer service at 1-800-375-5283 for further assistance. If you move, please use our Change of Address online tool to update your case with your new address

Today, my fiancé received the mail from USCIS:

Your petition for Alien Fiance’(s) (Form I-129F), which was approved by U.S citizenship and Immigration Services (USCIS), has been returned to this office for the following reason:

USCIS is administratively closing this petition because the original validity dates have now passed. This action is without prejudice to the filing of any future petitions or applications.

The returned petition will now be stored at this office and no further action is required

Is there anyone in the same situation? I am a little confused. Is it case closed or automatically revoked? What should I do? Do I need an immigration lawyer?

that petition was allowed to expire.

want to be with yer fiance? file a new I-129F

whatever red flags were there previously? address them, fix them, document them.

na, USCIS did. CSC or VSC, can't remember which one - they are sneaky about it, and usually allow it to expire rather than going through the extra paperwork of issuing a NOID/R and allowing the petitioner to rebut.

It's sneaky, but it is what it is. The Petitioner didn't allow it to expire - that was USCIS them own d@mn selves.

It's quite common that the service center don't look at them after they get them back from the embassy. I think it's CSC who's notorious for it. It's not the petitioner that lets the petition expire - it's the service center. After it expires, they send out a notice saying the petition is adm. closed.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days

sorry, VSC does that, a lot.

paperwork travel is important here, aye?

I-129F to VSC,

NVC

IV Unit then

K-1 visa application at IV unit then

INTERVIEW at IV unit with some problems at interview then

Casefile is returned to VSC and

VSC allows the petition to expire, without going through actual NOIR/D process with petitioner.

Sure, it sucks, but it is what it is.

CSC doesn't work this way, so that's a plus - they do handle NOIR/D with a rebut process to the petitioner.

We had filled a new petition couples months ago, after long time we didnt hear any thing from USCIS. We fixed and addressed our problems on new petition, too

I'm little scared now. If VSC let our previous petition expired, then we dont have any chance to rebut.What will happend? Do i need a waiver on my next interview because our problems on previous k1 are still there on their system. Pls. help
