Hi,

Its been over 30 days since we received the approval (NOA2)today I contacted NVC and they told me that the case has been sent back to USCIS for review. The also gave me the new NVC case number. I couldnt contact USCIS as it says to callback when the agents are available from 8am to 8pm monday to friday while i am calling on a thursday at 11am. None of us had been contacted either by mail or anything. just found out by calling them. so whats going on here? can anyone help?

The CEAC tracking website says its processing at NVC and that we should follow the instructions received and that if we lost or did not receive them then to contact NVC??

They're open local to where you're calling.

Are you overseas?

If I call from my skype, it's on central time, but if I call from my cell, it's eastern.

Did you try asking for a manager or tier 2 person at the NVC to find out why it was sent back to USCIS? If not I would try that to see if you can get any information.

I was about to ask for a tier 2 manager/agent but she told me that normally it can take up to 120 days for the review.

USCIS said they have not received the returned petition as yet. so better to wait and check online to see if its received and then call.. haha

i was hoping to find someone who had gone through this and completed the process?

Very strange indeed. especially since they have issued an NVC case number. Maybe they were missing vital documents or something. Just try to stay on top of things so thjey dont forget you.

09/26/2012: Mailed I-130 from Nigeria( delayed by customs)
USCIS stage ( 66 days)
10/12/2012: NOA 1
12/17/2012: NOA 2 (case was transferred to NYC office 11/27/12)
NVC stage ( 20 days)
01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!
05/13/2013: POE; JFK


N-400: (3 months and 12 days)
Filed N-400 : 2011-06-17
Interview: 2011-09-27
Oath Ceremony: 2011-09-30

IR-5 for Mom Entire process took 5 months exactly
USCIS (22days)

mailed I-130 : 2011-09-30
NOA 1: 2011-10-03 (text & email)
NOA 2: 2011-10-25 (text and email)
NVC: (19 days)
Case entered and # assigned: 2011-11-18
NVC Case COMPLETED: 2011-12-07 ( 43 days from NOA 2 and 65 days from NOA 1)
Interview Date(Lagos): 2012-01- 23
Mom was late for interview
New Interview date: 2012-02-29 : VISA APPROVED

Well there is one thing I found out if it is relevant. At the website http://ceac.state.gov when I use my NVC case number, it says it is processing at NVC as a nonimmigrant visa application? Isn't it supposed to be immigrant visa application? It's an I-130.
