I-751 Waiver (due to divorce) success!!

Wow what an experience! My girlfriend has successfully gone through the I-751 removal of conditional residency status (with waiver due to a divorce) with much ease and success thanks to the great information on this forum and help from various members specifically Sandranj. Myself personally having never been exposed to anything regarding the immigration process, I can say the hoops and hurdles that must be conquered was an eye opener. To say immigration reform is needed is an understatement.

My now girlfriend was visiting family here in the states, as she did every summer, when she met her husband. She ultimately decided to not go back and obtain her masters degree at the university as she was certain she had found the type of person to share her future with. She soon found the true colors of her now ex husband as he lied about his income, misleading about his goals in the future, verbally abusive, and unfaithful. With all of this happening within the first 14 months of the relationship she was lost on what to do. She had put off going back home and continuing her education to be a wife. No one deserves this kind of treatment so she filed for divorce in June 2012. The divorce was finalized October 2012. As soon as we received the divorce decree I helped her file the I-751 waiver application. (You must file I-751 right away after divorce is final) We sent our packet of info to USCIS in California December 5, 2012. We received the extension letter first of January 2013. Having such a short marriage and time together, we were concerned about the lack of evidence (more on that below). However, we never received an RFE. We received a notice to appear for an interview on March 8th, in first part of February. The interview took a total of 10 minutes. 10 green card on the way!

Here is the evidence we submitted:

Lease with both names

2011 tax transcript

some mail showing both names

5 affidavits (1 from her ex stating he didn't oppose her staying in the US, 1 from her brother in law, 3 from mutual friends detailing time they spent with them both)

Joint checking account statements (just a few spanning the period of marriage) (she had issues at the first of the marriage with getting original green card (lost in mail) and consequently social security card causing delays in starting work and didn't have but a few months of financial co mingling)

Detailed statement of my girlfriend, detailing the relationship

12 pictures from throughout their marriage

A separate checking account with her USC husband listed as beneficiary

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

congratulations! I am in the situation as your girlfriend was. Could you share some experience of the interview? Like what kind of questions they may ask? Thanks

The interview was very quick like maybe 10 minutes. Basic questions asked involved verification of dates birthdays anniversary dates moving dates thing such is that. Asked her about a trip she was on that she had some re entry trouble with.

She also had a very detailed statement Spanning in detail the length of their relationship. When you go for the interview make sure that your dress professionally and

I just had my appointment this morning. And since I spent the entire previous night perusing blogs and forums to hear about people's stories. I thought today, I would tell you about mine. 

 

THE BRIEF: 

Met my boyfriend in 2009. We moved in together in 2010 (his apartment - not a lease with both our names)

We moved in to a different place, both our names on the lease, summer 2012.

We got married in Nov 2012.

We got divorced in October 2015 (filed for it in May 2015, but had already been living separately for almost a year).

We are still friends. 

We just fell out of love. (hectic schedules - film & restaurant industry, money problems, etc...) 

 

THE CASE:

We filed to remove the condition on my permanent residency jointly. But by then our divorce had been pronounced so I filed for the waiver. I had to send some additional paperwork. I got a letter in the mail saying it wasn't enough. So I submitted more (but not much more). And got a letter asking me to come for an interview to discuss the removal of the conditions on my permanent residency. i-751 case.

 

THE INTERVIEW: 

The notice asked me to bring EVERYTHING we had already submitted and more. I brought so many documents with me!!! HOWEVER, the USCIS Officer did not take ANY of them at the end of the interview. She said "I have enough". (I'm hoping it's a good sign, and I convinced her enough during the interview that she doesn't need the evidence to support it.... but maybe it went bad, and she knows she's denying me so she also doesn't need the evidence. I do not know).

 

So the interview. OH MY GOD. So long! So intense! So personal! Get ready people! It lasted over an hour. She went into detail about our entire relationship. When we met. How we met. How long we dated before getting married. How long were we happy for while married. Why did we divorce? What did we try to do to fix things? Did we do couple's therapy? We talked about sex. Intimacy. His family. My family. We talked about children. If we wanted children. When. Etc. Money was also a subject. How we handled money in the couple. If someone was paying more than the other, and how the other one felt about that, etc.... I literally felt like I came out of an entire day of therapy. 

 

The USCIS officer was a lovely woman. Very friendly. Polite. She seemed understanding. VERY thorough. But always pleasant... I even got her to say "men are so dumb" (sorry guys, but we all know that's a fact!). 

 

Like I said, at the end, I told her I had all these documents for her, but she simply said "I have enough" -- I wanted her to take all of it! I had so many letters written by friends and colleagues, talking about our relationship. I feel like maybe I didn't give her all the information. She could have gotten a better sense of our relationship with the whole folder! Anyway. She said I will receive her decision in the mail within 2 weeks. Which seems quick? Thoughts?? 

 

Basically. It's like going into therapy. So get ready. 

 

I have NO idea if it went well or poorly. Like I said. It seemed like a conversation with a therapist. Sometimes I said the right things, sometimes I definitely said the wrong things. But all in all. I was honest. And it was really just a conversation.

 

I'll update in 2 weeks to let you know if I got approve or not!

Hi!

 

It's been a week, still nothing, to be expected, I'm sure. Especially with a holiday in the middle. 

 

I sent my original i-751 ago such a long time ago, I honestly cannot remember. But I'm on my 2nd extension already since trying to remove the conditions, so it's been almost 2 years. ( expires in June, so yeah). It took over a year to get the RFE, and then another few months to get the notice for the interview. 

 

From what I've been told in passing, USCIS is very overwhelmed and i-751 have been taking longer to process than usual. (No idea if it's true or not).

 

I'll let you know once I receive the results in the mail.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
