Hello,

My GC is set to expire on 3/14/13 (tomorrow). Because of legal troubles, I had to wait until yesterday to be able to send everything away to the VT service center. I sent it by Fed Ex overnight for it to arrive on 3/13/13 by 12:00pm. I have spent the entire day on the phone with Fed Ex, because the package was not delivered and had to be located. Turns out one of their trucks was delayed due to weather and the package will not be delivered today, but will instead be delivered on 3/14/13 the same date my GC expires. I've scoured the internet for people in the same situation and there seems to be different outcomes. Some people receive their NOA, and some have their applications outright denied. I'm not worried that they will deny the application based on the evidence but I am extremely worried that they will outright deny the application because of it arriving on the same day the GC expires. I realize that it will probably not make it's way into somebody's hands until a few days after getting there.

I don't know what to do, I tried calling the Customer Service Number and the only information I was given was that I had to wait to receive a receipt. Should I send an explanation of why it was late now or wait for one to be requested? Is there any way I can track if my application has been received or accepted/denied, or is the only way to check is to see if the check was cashed?

Has anyone been through this? Please help.

personally I feel your application will be accepted , just wait and see. I don't think you can do anything at this moment

day 86-- 07/05/2012-- Received my GC in the mail.

Hopefully it will be delivered tomorrow 3/14. Even if it is a day late, I don't think USCIS is that regid but let's hope it get there tomorrow.

USPS delivers to the USCIS Post Box but I am not sure if that would have made any difference in your case.

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)

10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

I'm not gunna lie, they might deny it and IF they do they could still cash the check first and then deny you, or they might reject the packet for late filing.

If it's the latter, then I would send it back with a letter explaining why, seeing you had a 90 day window, you waited until so very close to the expiration of your card.

Tomorrow your card expires, you have no prove of legal status. You are technically not permitted to work and you cannot leave the US without your extension letter. So you will be waiting about 2 weeks I would say (sometimes quicker, sometimes slower) before you can work again and know where you stand.

Out of interest, WHY did you wait so long? if it's a good enough reason you should be fine when/if they ask for a letter of explanation.

It is a good reason and I think that it will be okay if they ask for an explanation but I would rather not share. I just don't want them to flat out deny the application and was hoping that the odds of that happening were lower versus getting an NOA and then an RFE. The package was finally delivered this morning and I requested Fed Ex to send me a letter explaining the delay so that I can include that with my explanation if/when it is requested. Thanks for your help.

Just for the record cookie, we aren't prying about the reason, but what you think might be reasonable, the rest of us might already know is unreasonable, so that is why we ask. Not the gory details, but enough to be helpful not just to you, but also to others in a simular situation, so tell us what you can so that the hundreds of others who read this get educated as well

I understand, the main reason was that I got into trouble with the law in the beginning of February, a minor offense but the court date wasn't until right before the expiration of my GC. Nothing to do about moving it up. If I had sent my paperwork prior to the court date, I would not have been able to include anything showing a final disposition for the case as required by the instructions. The final disposition was favorable and I was able to include that with my application in the end. Maybe I should have sent it without one prior to the court date and then send the disposition in response to the RFE...but chalk it up to stress and not thinking thoroughly, I didn't think about it then. Lesson learned...

You're right, in hindsight you should have sent it then sent it in response to the RFE BUT I think you should be okay. In your letter write something like "the instructions required that I include the final disposition of any court matters and I did not have that information yet, so I was waiting to get the final disposition which I then included in my packet.". Should be okay :)

My own recent story is *identical* to yours...

My Green Card was set to expire on March 7th. I was able to finalize the packet on March 6th (took forever to get tax returns from IRS), and sent it with USPS Express. It got there on March 7th at noon. The very day my GC expired.

So I was fretting. Two days ago I got a letter from USCIS, dated March 8 (one day after GC expired) saying my one-year extension had been granted.

I hope the same happens to you. They are strict, but not completely heartless.

06/01/2008: moved in with roommate.

01/03/2009: began romance with roommate. Things are awkward for a bit.

05/15/2009: OPT expires.

06/11/2010: married! In Vegas!

10/13/2010: package sent to Chicago lockbox

10/22/2010: package received.

11/19/2010: Biometrics app. Done. Extremely friendly staff.

01/06/2011: I-485, I-130 initial review. I-765 in production.

01/15/2011: EAD received

02/05/2011: Interview notice received

The problem was sending i FEDEC, you should have use the USPS, either priority or express. FEDEX has no obligations to delivery during bad weaher, were as the United Postal Service does.

One to two days late will not cause you any issues.

I wanted to provide a quick update and thank you all for your replies. I received my receipt with the year extension in the mail on Monday 3/18, the receipt is dated on 3/14 the same day that it was received. I did not know that Fed Ex has no obligation to deliver during bad weather, in my head they had always seemed more reliable than USPS...Clearly I was wrong!
