You say that you "have gotten jobs before". Have you ever been formally employed, and filled in an I-9 form? Is there any possibility that you ever claimed to be a US citizen (even inadvertantly)?

Andrea, It is AWFUL! lol I have never known any different though, and through all this ive been trying not to break the law by driving and i have gotten jobs before, but I have to LIVE, and I grew up here, this is my home. If they were to deport me or some crazyness, i literally would not know what to do in south africa. I have some family and friends down there, but here is where i have made my home. I am just ready to go to school and do something with my life other than be a stay at home mom. I am sooo sick of it. I love my kids very, very much. But I WANNA GET OUT OF THE HOUSE!! :dance::yes: Also being able to earn more money is going to be better for our kids.

BTW, I spoke with the paralegal a few min ago and she said that I will recieve my work permit within a few weeks of applying. Before I even go to my marriage interview. Pretty excited about that :D

Yeyyyy!!! we all receive the EAD (work permit) a month later after the biometric... sooo! with your EAD you can not only have a valid SSN but also you can apply for a driver license and get access to any kind of jobs :):dance: :dance: :dance: and I totally feel you when you said you want to be OUT of your house...HAHAHAHAHAHAHAHA that was me a few month ago! Im very happy for you

Um, I have never said that i was a citizen. I always just said I was a perm. resident I think, But when i was 16 and got my first jobs, the hiring person always filled out that stuff. Basically just asked for my ID or whatever. I honestly knew I wasnt allowed to work, but "winged" it per say. They would ask for an A number but i just said I didnt have one and hired me anyway. I have no idea what an I9 is but I did fill out w-4s. Why do you ask.. I mean, its bad to lie but I know for sure I never stated I was a citizen..

I don't see how they could deny you, you were married too long already. :) If you were really shooting for the green card, you would not have children with him. And it is not your entire fault solely that you fell out of status. It is your parents' fault. So I would not worry, but again, I cannot give you advice because even though I've been here ever since I was 5, we were legal the whole time with my family, and even after my parents passed away when I was still young, I managed to shove myself into school (have the government pay for my tuition-LOL) and maintain F1 status. Before that I was on H4 (through my parents, and before H4 I was on J2, and before J2 I was on B2). So, the whole time I was on visa here and grew up here. So it is not the same situation as yours, but I don't see why they would deny you for being here illegally. You're married for a while, so that is going to help you big time. Good luck! By the way, your kids and your age made me smile as my Mom had all four of us (and I, myself, am a twin as well) by the time she was 21. Sounds so like my family was. :) Anyway, enough ramble, good luck!

LOL! I am seriously not going to be able to breathe right until this is all over...lol One of the other reasons it has taken me so long to file is bc i am nervous...not about marriage, but about being out of status for so long. I hope to god I have a nice understanding interview officer...

Yep our kids are almost 6, 3, and 8 months. 3 girls and a boy. Our son is a little replica of his daddy... and driving me nuts. My oldest is in kindergarten and is already reading on a 1st grade level, and my wittles are starting to crawl and eat tiny things off of the floor..LOL! I am BUSY all the time. I really think it will get easier when the kids are older and can do things by themselves. I feel like my hubby gets a vacation from the kids by going to work. :lol: He obviously doesnt see it that way, but eh. Its true.

Its funny though, like people give us grief for getting married so early, and having kids so young, and all of it. But we made it, through all of our arguments and issues and kids. We still are together and have never separated or been away from each other.

That is amazing how you were able to keep your status through all of that!

Day 59 03/21/2013 Interview at 10.30 am Seattle Approved

Day 67 03/29/ 2013 Greencard Arrived . Applied for SSN

Working is not a reason to deny AOS. But claiming to be a US citizen is

Listen, no need to be freaked out. It's a process based on rules and regulations and not emotions.

You've been in the US since you were a toddler and were heavily involved in US immigration process so I am sure you know the significance of claiming to be USC if you're not.

OK, wheeew. Thanks for the reply. I have another serious question though. When i filed for my 1-30 I lived at the same address when i got my approval letter, but moved a little while later. I have never updated my address, I didnt think I had to since I didnt have anything else processing or a work permit or anything... Should I have updated it? Should I now? Or just tell my attorney? and let him take care of it...? Oh lord, I wish I had known about this site years ago!!!

Is there anything on here about rating attorneys?

Hey everyone! I stumbled upon this site, bc i am currently finally filing for my AOS and hired an attorney TODAY!!

Ok so I immigrated here to visited the US in 1994 when i was 6 years old with my parents and two younger sisters.

We came here LEGALLY on a B2 visa.

our I-94s expired.

I met the love of my life at 17 years old. We dated for 9 months and got married 2 months after I turned 18. It was 2006.

We filed my I-130 and got approved!

2013!! - I litterally just hired my attorney today! Sent through express mail, a list of things he requested and paid him... so now just waiting for him to call and let me know what else to send and what to do from here...

There you have it. I am a legally immigrated, illegal, married to us citizen, we have 4 kids together, love each other and have been married for 7 years on may 26. I have NO drivers license, a ss card that says NOT VALID FOR EMPLOYMENT, and expired i-94, expired passport. Its crazy!! Noone can believe i have been in the country for 19 years of my life and still have NO STATUS.

Your situation is not unusual. You entered legally and then overstayed. You are married to a USC.

As long as you have a sponsor and have proof of living together, financial co-mingling etc (and never claimed to be a USC, or had someone tick a box FOR you claiming you were a USC) you'll be fine.
