I'm sorry if I posted in the wrong thread.. i really have no idea where to post my case..

Hi guys first of all I am Florence Panting age 28 and I was born in Reno, Nevada USA. When I was little my mom decided to go back to the Philippines in which we stayed for quite a while then usually I go back and forth to the US since they only give me less than a year to stay in the Philippines. Then I grew up and had a wife and two kids I was wondering If I could bring them in the US even though I'm here in the Philippines and don't have work at the moment. Hopefully I could get an affidavit of support to my relatives back there in the US.

So what I did was I setup an appointment on March 15, 2013 at the US Embassy in Manila, Philippines about my wife (FORM I-130) and my two kids. (CRBA) then I think i'm going to pay some fees and send some documents there.

I was just want to know if I did some thing wrong or if I did everything correctly.

Is it possible that I could go back in the USA along with my wife and two kids?

If the I-130 form and CRBA got approved how much longer are we going to wait for their visas to arrive?

Lastly, yes i'm so desperate i want to bring my family in the us please help us. :(

What you are doing is a direct consular filing (DCF) and I think you can petition with that. It will be DCF if you have permanent residence abroad that is legally established for a period of six months prior to submitting an I-130 petition. You can bring them however I do not know if you can do this without having any job since they ask for an affidavit of support. Philippines consulate does allow a co sponsor but remember that the co sponsor must have enough money for the whole family including his if ever the sponsor has other dependents. I'm currently here in the philippines so I think that's a confusion with my "6 months" residency prior to submitting an I-130. How's that? :(

I see a few potential problems:

- For the kids CRBA, do you have the physical presence in the USA? Did you go to school/ college in the USA, file taxes stating you are a US resident?

- As a US citizen, you are supposed to file US taxes every year, even when living abroad. Did you?

- Are you planning to go live in the USA now? It sounds like you are currently living in Phils, and for your wife to be approved for a visa you must be domiciled in the USA or show intent to re-establish domicile there, and then for your wife to keep her greencard, she must spend the majority of her time every year in the USA.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Here are my answers

1. I do have physical presence in the US, last 4 years ago I was working there but that's only for less than a year.. I did not go to school there because when I was little I used to study here in the philippines and I think I only filed my taxes once..

2. Yes I'm really HOPING that my wife gets approved so we could live in the US for good. And I think when she gets accepted and got her green card we will live there together working..

I'm currently here in the philippines so I think that's a confusion with my "6 months" residency prior to submitting an I-130. How's that? :(

I do believe that the 6 months permanent residency meant that of PI. You need to have stayed in PI for at least 6 months so you can file at the USEM. :) Penguin is right though. You need to establish a domicile or house in the US and at least have filed your tax returns. Anything that can prove that you are "living" and wants to live in the US.

With domicile or house, you do have relatives right? If you are staying with them while in the US then you don't have a problem. If you have your own house then much better.

If you chose them to be your co sponsor then yes they have to file the affidavit of support. :) Remember though that to be a co sponsor they need to support their current dependents plus you and your family. Make sure they have enough. ^_^ Kindly ask the USEM also if there are any changes with the co sponsorship since you did say you have an appointment with. Always pays to be updated ;). I'm still wondering about your tax returns though. You should have at least filed them. You being the USC and having someone to co sponsor you is good but it is better if the US government can see that you have been living in the US and won't be a liability along with your family. I hope you can sort that out with your appointment.

For now I can say that you are filing for DCF since you have been living in PI for more than 6 months.

When filing an affidavit of support, you have to file for the petition first then after that they will require you to produce an affidavit of support or co sponsorship. In your case a co sponsor.

Why don't you just go back to the US and find a job first anyway? I think it's more solid that way. :)

Yeah that's the thing though we're just taking our chances that maybe I could bring my family in the US back with me.. It's so hard leaving them alone.. :(

Awwwww. I know the feeling of seeing someone you love leave but remember that you are not leaving them. In heart and mind you are together :) Try it! ^_^ I mean you are still going to get them via this route someday when you have a job. If not now then maybe in the future when you have a job. Good luck with your journey :)

Okay guys we've received our NOA1, we have sent our petition last March 15-21,2013 and we have received NOA1 last APRIL 12-20, 2013 (including courier).. I hope everything goes well after this.. Thanks everyone for all your help!!!
