Hi Everyone.

Please help me. I am so frustrated with my green card application. I must finished my green card package this week. It's kind of emergency. Please help me.

My story first: I got my K-1 visa November 2011 using my Chinese passport in Canada and I crossed the border in Idaho in January 2012 the first time and I had my first form I-94. In March my tooth was hurting so much and I was still on my maternity leave so I still had full dental coverage in Canada. Plus my husband didn't work and fight with me. So I flew back to Canada to fix my tooth because my I-94 is multiple entry. But I found my husband took my form I-94, so I drove back to USA at the same border in Idaho the second time and got another form I-94. We got married in April and I mailed my I-485 package in June 2012. But My husband and I kept fighting. We went to court to fight our son's custody and I was so tired and I decided to go back to Canada but the judge refused me to bring baby out of States. I was very sick and I drove back to Canada in August 2012. I showed up on the biometrics appointment but I didn't show up on the interview in September, so my I-485 got denied in December 2012.

We kept talking on the internet and I missed my son so much. He is just one year old. I got my Canadian Citizen in January 2013 and my husband really wants me to go back with him and I drove back again after I got my Canadian passport. I crossed the border in Montana with my canadian passport the third time and told them that my husband is going to help me to file I-290B to reopen my I-485 which was going to expired in 5 days. So they let me cross the border and I got the third form I-94, 3-month advance parole.

We filed form I-290B but got denied again. So we went to USCIS office to ask advice and they asked me to file Package I-485 and I-130 again. SIGH. Money. And I must get my I-485 open at the end of this month because 3-month advance parole. So please help me.

My questions are:

Form I-130:

C14 : Arrival/ Departure Recoed (I-94) number and date,

I have 3 I-94 forms, which one I should write down here?

C16 : Has your relative ever been under immigration proceedings?

How can I fill this question?

Form I-485:

Part 1: Date of last arrival?

I-94 # ?

Current USCIS status? Expires on?

Part 2: Which on I should choose? Is it C?

Part 3: Place of last entry into the United States?

In what status did you last enter?

Form I-131

Part 1 : 3. Class of admission?

Part 3 : 4. Have you ever before been issued a reentry permit or refuge travel document?

I don’t know how to answer this question. First before I drove back to Canada in August last year, I got one card, Employment Authorization card, on the bottom is written, Serves as I-512 Advance Parole. Second I got the third form I-94, It’s written paroled, purpose, humanitarian. Is one of those called reentry permit?

If your current I-94 was "humanitarian parole" I don't think you can adjust status. You are not admitted to the US, just paroled.

I think your situation is a bit complex, you applied, got denied, paroled, Canadian citizen now, son in USA, etc..

Let's just say not many can answer like that on the fly, so please be patient or get a lawyer at this point to be safe..

I would rely on Internet forum advice for more straightforward case questions.. :) My 2 cents !

Honestly, you need an attorney. Some of your OP doesn't make sense. For example a K1 doesn't get a "multiple entry" I-94 so I think maybe you meant K3?

Anyway, I agree with I'm not sure you can AOS based on a paroled entry... that makes the situation complex, not to mention you entered with immigrant intent. You don't want to waste the $1500+ you need to spend on the process without speaking to an attorney first.

I'm not sure about this one. Usually it would be the one from your most recent entry. But that was a parole, so I'm not sure if that counts.

C16 : Has your relative ever been under immigration proceedings?

How can I fill this question?

I believe this is No. If you look at the form, this is stuff like Removal, Exclusion/Deportation, etc., and you haven't had anything like that.

Form I-485:

Part 1: Date of last arrival?

I-94 # ?

Current USCIS status? Expires on?

Same issue as the I-94 above. Not sure. Usually it's the last entry (and your status would be "parolee"(?)), but it might be the one before.

Part 2: Which on I should choose? Is it C?

I think you choose "a", because you are now adjusting status based on the I-130 and not the K-1. (Plus you didn't get married within 90 days of entry anyhow.)

Part 3: Place of last entry into the United States?

In what status did you last enter?

Similar issue as above about last entry.

You don't have to answer that, because you're applying for an Advance Parole, and right above that question, it says, skip to Part 7.

I went to USCIS office to ask them advice and they ask me to file this package because they said I am in USA. Don't scare me, my dear. I am very frustrated by this package. :blink:

The USCIS office doesn't know your personal situation. They gave you the correct forms to file, for sure, but whether you'd be approved and SHOULD file them is a different matter.

Speak with an attorney.
