I petitioned for my husband with an I 130 in August 2009. It was approved at the Baltimore field office in May 2010. Everything sent to the visa center. He had an interview at the embassy in March 1, 2011. Which they denied his visa. To this day we have never recieved anything from the embassy telling us what to do next. Despite having contacted the embassy myself over the past two years. Where they told us to apply for an I 212 and I 601 in the spring 2011. To take it back and say no you don't qualify in June of 2011. To calling my husband while I was visiting in July telling us to supply them with his deportation documents. We travel to the embassy and they say they don't know what we are talking about. After hours of calling outside the embassy finally get someone who knows what we are talking about and tell us to file an I 212 and I 601 waiver. Which we go back gather paperwork and do. In November 2011 , the waivers were denied. We had 30 days to appeal no new evidence waited. Then I contacted the embassy because we never recieved a decision in the I 130 case. Everything in the U.S. says it is in processing. I went to visit my husband this past summer and came back and surprise I am pregnant with our first child. I made an appointment with our Baltimore field office to find out what is going on. They told me I couldn't file because they approved the decision and that the embassy should have sent it back if they didn't agree with them. The recommended I call the National Visa center I went home and did just that they said the same thing it should have went back to them and then to the Baltimore field office for review. They suggested I contact the embassy. After three weeks of hearing nothing from the embassy I contacted the senator in my state who got back to me with an email from the embassy telling us to schedule a IV adminstrating process interview in Oct. 2012. We did the next available date was January 17, 2013. My husband went and the embassy didn't know why he was there even with the letter from the embassy and the letter from the senator's office. I contacted the senator again and they told me to contact the DHS office. I did they told me the case is still processing and eventually gave me a number for someone in Washington D.C. that works with the embassy. It goes straight to voice mail and no one calls you back. I am completely frustrated and upset with this process. All fingers point to the embassy but no one is willing to help. The person in the DHS office said it sounds like the embassy did not follow appropriate procedure. I have said this over and over again to people I talk to in every department to the point I think they all think I am crazy. No one is willing to help straighten this out with the embassy. Especially when the offices here tell me I can't refile because the embassy never sent back the paperwork. Any help or direction to go in would be appreciated. I don't know who to contact anymore. All I know is I am 33 weeks due the end of April and need my husband here. They have held up this process for 2 years. With all the emails I have written with the info I was given and no one answers my questions. HELP PLEASE

You mentioned something about your husband being previously "deported". Why was he deported? Depending on the reason, it could be why his visa and waiver application was denied.

I suggest you seek the help of an immigration lawyer. Good luck.

You mention 2 waiver that usually mean that the person was here as an overstay and was deported. Did this happen and when ? Was any criminal activity involved ? We need to know more to make suggestions. Can you tell us if your husband was ever in the US, how he got here and how he left.

This will not be over quickly. You will not enjoy this.
