You filed 2 weeks ago. The entire process can take 6-12 months. You're 4 1/2 months pregnant. Unless he's able to get a visitor visa, he won't be with you at the birth. :(

Unfortunately you're not the first, and won't be the last, person to give birth without your spouse around.

I should mention, although I'm sure you have already thought of it, it isn't impossible to give birth in his country. Obviously, there are various difficulties with that, and your child can never grow up to be President of the United States, but it might mean a lot to the father.

I do hope so and thankyou. Yea expediting it won't work. Wish it would but I just have to wait it out.. :bonk:

we tried to expedite it though we know it's not a reason to speed up the process, but we still give it a shot. nothing happened. :whistle:

I was thinking about getting a lawyer for that, but since I called and asked they said they could try and I would have to get back in 5days, but thankyou :)

and lawyer cant do anything to speed it up.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Dont get a lawyer. They can't make anything faster, only waste your money. Request the expedite on medical reasons, cite pregnancy. But, many have done this before with no success. Again, it won't hurt.....

I would recommend you disregard that person's post (madtownguy), he has been posting unnecessary info and about getting lawyers on almost every comment he puts down.

:ot2: Why do you think you need a lawyer? Is there some special complication in your case that only a lawyer can handle? If not, getting a lawyer will just be expensive and won't make your case any faster (you could probably do it faster by yourself). They can't change anything in the immigration process, therefore, you'll just be paying someone to fill out forms and file documents that you can do by yourself. If getting a lawyer will make you feel better and you want to spend all that money, it's your choice.

As suggested, it’s a long, long shot, but applying for a B-2 visa might go through. Keep in mind you want to be honest about your K-1 Visa, if asked, but get a letter from your doctor indicating that you are pregnant and send to your fiancée. Now here’s a suggestion for the B-2 Visa. I’m assuming that your fiancée may or may not have the finances to apply for a B-2, if not, you could send your fiancée an I-134 ADOS. Along with whatever paperwork you send your fiancée to apply for a B-2 Visa, have your Federal Representative or Senator write you a personal letter requesting that they allow for this B-2 due to your circumstance. If the CO at hand does not think your fiancée is a risk, you might have a slight chance. There is no harm in trying.

Thank you guys for all the advice :) .. expediting didn't work. I don't think hiring a lawyer would help me that much and would only cost me extra. I just gotta stick it out I guess. I'll try looking into the B-2 Visa. Hopefully he could visit by the time I give birth..
