It's clear you're trying to lie about something now.

You can stop that right now.

By the time your interview rolls around you will be REQUIRED to provide 2012.

Otherwise, you need a later stating why you are tax exempt for 2012.

Why is your husband evading the tax man?

I do not want to lie. I am not very well aware of the laws in america. I am trying to find a solution.

He did not pay taxes, he cashed the money without paying taxes. Can he still file for 1040 if he didn't pay taxes?

Yeah, I know in some countries they have that "internal passport" or the equivalent there of that tells you where you can legally live. Glad we got that cleared up for you :)

Do not remove the jobs if he actually worked there during those dates.

Honestly answer every question. Under no circumstances should you ever leave something out or lie.

If he made under the taxable limit he doesn't have to file a tax return and should state that. However, it would be in his best interest to file the tax return for 2012, as he still has until April 15th to do it. We are talking about his income in the year 2012, correct?

As I mentioned, he worked, got paid , but didn't pay taxes. He said that if he didn't pay taxes, he cannot file for 1040. Maybe he has no clue about this, I do not know... I am trying to find out what he can do. I want him to file for 2012, but he keeps telling me he cannot, cause he didn't pay taxes.

Hi,

As I mentioned, he worked, got paid , but didn't pay taxes. He said that if he didn't pay taxes, he cannot file for 1040. Maybe he has no clue about this, I do not know... If he worked and he made above the limits for filing he is legally required to file his taxes and pay back due on any he owes. He probably doesn't want to file because he owes taxes. He doesn't have a choice but to pay them in order to bring you over.

You can file a 1040 and write $0 for income. I've done it before and it is perfectly legal to report whatever your ACTUAL income is for that year, whether it be $10 or $20000. :thumbs:

If he worked and he made above the limits for filing he is legally required to file his taxes and pay back due on any he owes. He probably doesn't want to file because he owes taxes. He doesn't have a choice but to pay them in order to bring you over.

You can file a 1040 and write $0 for income. I've done it before and it is perfectly legal to report whatever your ACTUAL income is for that year, whether it be $10 or $20000. :thumbs:

Do you know what is the percentage for taxes? For example for $10,000, how much taxes should he pay?

It can get very complicated with deductions and things. It is best to use a program that does it or get an account. I use turbotax online. I think they charge $20 and it might be free for low income folks.

At $10,000 it shouldn't be much.

If he does married filing jointly, it will be around 10%, or married filing separately around 15% before deductions.

1040EZ is free on turbotax.

For one person, the AVVVEERRRRAAAGE-ISH tax is around 20% when claiming 0.

So $2000 should have come out of his pay-checks if taxes came out like normal.

However, then he would have gotten some back.

Really, you'd have to actually do the taxes to find out.

I am from Romania and I work in Romania for the moment. I do not think he can use my income for the affidavit of support. right?

Hi,

I was referring to something else. Let me rephrase that: When they are checking his income to be bigger than 125 % than the Federal poverty guideline, what exactly are they checking? His actual income? or his old ones from the past 3 years?

If he has money in an account here in Romania, would NVC consider them too? Or should we transfer them to USA?

His current income. What he makes now. It wouldn't matter if he made 200k last year if he only makes 10k this year. They want his current income that is not temporary or conditional.
