Visiting husband while the petition still in process

Hi all...I m new here. I would like to seek advice. I m married to the us citizen last year in my country. He sent I 130 in early February 2013 and received Noa a week after that. Earlier on, I applied for visitor visa just before we get married and it was denied due to the obvious intention to stay. Is there any possibilities I can visit him in the States while waiting for our petition to get approve? If so, what type of visa I should apply? Another question is, should my husband also send i129 fiancé petition as well? Thanks in advance.

If you were denied a visitor visa, then there is no way you can come here to visit until your spousal visa (I130) is issued. Since you are married, applying for a fiancee visa is futile (it is for unmarried people ONLY).

Thank you. So now all I can do is just waiting for the petition to be approved before I can apply for the relevant visa, right? By the way, is it true that my husband income must be at least 30k per year in order to be eligible to be my sponsor?

yea, what bt1 said was absolutely right, there is no way u can visit to the States until ur spousal visa (I130) is issued.

my husband is an active duty military member, he came over to Malaysia from Texas and we married here.. he filed I-130 during mid Jan, there is nothing we can do but wait.. :blush:

this is the hardest time.. and i totally understand your feelings as we're in almost the same situation. my noa1 received.

be patient is the only thing.. meanwhile, try start prepare for your interview session.. and why not do some necessary research about it.

You can try for another tourist visa but your chances of getting approved are very slim

Don't do the K3 path/ file I-129, it will not speed things up.

How much money your husband needs to make depends on how many people in your household (you, him, any kids you have/ you have together/minor kids from a previous marriage he has/ other dependants he has). If it's just the two of you, he only needs $20'000.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thanks a lot. My husband has 3 kids from his previous marriage and all staying with him (i dont have any ) . How much money he must have in order to sponsor me then?

Since you are a household or you+ husband+ 3 kids= 5 people, he needs an absolute minimum income of $33'762
