How do I send my fiancee back to her country?

I'm not sure, but I think VAWA stands for Violence Against Women Act, not Violence Against Married Women Act. I should go check it though.

The VAW Act applies to battered immigrant "SPOUSES" only and not "FIANCES."

My fiancee wants to go live with the guy she has been chatting (behind my back), and I found out my fiancee went and applied for her social security card which will be coming to my house. Are there any ramifications about this? Thank you.

That would imply that her intention is to stay in the US, and she can't do that legally unless she marries you or goes the "abusive spouse" route. Since you are not getting married, well you figure it out. CYA dude, there's a possibility she's setting you up.

If she does move with the other guy, couldn't you just send the card back= Return to sender? she wouldn't be living with you anymore, so maybe this would be a good way of letting them know that she's changed her address.

uh...that would be no. It applies to all women

you are both right.....the whole act is about protecting Women, the portion of the act that can get the residency without the usc specifically excludes fiances. Interestingly, it doesn't exclude husbands. That part doesn't help anyone here, I just find it interesting.

If she has the right to apply for the ssn, you don't have the right to stop her, but if she doesn't live there, when it comes, I think you are supposed to write "moved" on the envelope and return to sender. Only if she's moved out tho, don't do that if she still lives there. I am pretty sure that the ssa wont forward ss cards without her applying again with the new address. But yeah, she just might be trying to create evidence of her intention to stay so be aware of that.

Wonderful. Fine. Great. IMBRA law applies to FIANCEE's (aka K-1'ers) and IMBRA was passed under the VAWA as I understand it. Quibble with it all you like. These women all think claiming "Battered Woman" is a free ticket to a green card. Who knows where they get such ideas, from their IMBRA briefings, maybe???

But the frakkin' police don't care if she's a SPOUSE, a FIANCE, a SISTER, an AUNT or just a BABE that he picked up in a bar... if she yells ABUSE, he can be in a mess.

And it still could become a DV -charge- (note, not conviction, but CHARGE aka Arrest) on his record that he would have to report in the future if he tries a K-1 again (see IMBRA for more information on this...)

Tell you what, YOU tell the police that she was only a Fiancee and not a Spouse when you throw her @ss out of the house and see how far that excuse gets you...
