I need some advice, not sure if this is the right visa for me

Sorry I just realised this is in the wrong place and I don't know how to delete it.

I'm sure there must be others in my situation, so I am hoping somebody can help me.

I am planning on coming to the US for a year, to be with my American partner, we do intend to marry and had initially thought a fiance visa would be the way to go, but I have been trying to do more research and I am just getting confused.

Eventually we plan to live permanently in the US, although that may not be for another 5 or 10 years. I am thinking since I will initially only stay for a year is there another visa I should apply for? I would like the option to work while in the US.

I am also wondering, if I come as a visitor and then marry would we get into trouble for that? If I come as a visitor will I be able to apply to work?

Thank you for any advice anybody can give me.

Coming to the US to get married and leave is fine. Using a visitors visa to enter the US with the intention of staying in the US is fraud and can/should lead to a lifetime ban. You can't work on a visitors visa, it's intent is to visit. Your friend in the USA , are they a US citizen or just a resident ?

This will not be over quickly. You will not enjoy this.

Coming to the US to get married and leave is fine. Using a visitors visa to enter the US with the intention of staying in the US is fraud and can/should lead to a lifetime ban. You can't work on a visitors visa, it's intent is to visit. Your friend in the USA , are they a US citizen or just a resident ?

He is a citizen.

So if we get married and I stay for a year that would be ok as a visitor?

As a visitor, you are only allowed to stay within 6 MONTHS and you can't gain employment.

Even coming for a year will be intent to immigrate to some degree and you would require a visa, the K-1 if you are a fiance. Because you intend to work and live in the US AND get married, you would be committing visa fraud to get married on the VWP and risk a 10 year ban if your intent is verified by immigration.

Basically: Intent to marry and remain in the US is intent to immigrate - even if only for one year.

12/31/2012 - Alien Number changed (NOA1 hardcopy in post, but was away for 2 weeks prior)

05/16/2013 - NOA2 received via text/email

05/20/2013 - NOA2 hardcopy received in post

05/28/2013 - NVC receives packet and assigns London case number

07/15/2013 - Sent all paperwork/medical complete

08/23/2013 - Receive Interview Date

09/19/2013 - Interview

You can come in on a visitor visa without the intent to stay and marry. That is legal. However if you adjust status to stay from a visitor visa, and entered with the intent to stay, that's considered fraud.

If you want to live here I'd apply for a K-1, you adjust status, and in a few months you'd be eligible to work, or you can get married while visiting, apply for a CR-1, return home and when you come back to the states you'd be able to work right off.

My guy plans to come here to live, although that won't be until June 2014, as his daughter is having a baby and he wants to be there for her first year, so I said I will come there for a year, as I don't want to be apart from him any longer.

I think that the fiance visa will be the best option, I was just worried about him having to start off the process and fill in all the paperwork as he gets headaches a lot and doesn't need all the added stress, I will need to discuss it with him.
