Ok so my 2cents. Had this been a one time thing maybe no big deal. Also if it was not a form for a background check once again maybe. I had a background check done recently not only did it ask country of birth but also country of citizenship.

Even an I9 form if no fraud was intended, can be defended according to a lawyer I know.

Is there any evidence of a long term LPR that claimed citizenship with no fraud, meaning no false documents being deported?

Because I have seen some people being denied and told they have to wait 5 yrs. Or maybe that was for registering to vote.

Paul and I have been very patient with extra checks. We realize that because he wasn't born here we are asking for privileges that will require extra time to process. And they are, indeed, privileges. It's not the extra checks we've been baffled by. It's that in almost every instance when we inquire as to how to go about obtaining the privilege or if it's even afforded a non-citizen if we get differing and largely conflicting information among the officials of the same organization. For example, at the DMV, Paul went in to ask how he could get a driver's license AS a non-citizen. The lady(aforementioned 7 weaker) gave him a rehearsed answer and a piece of paper telling him what documents he needed - if he were a citizen. Okay, she's really just the desk person and probably doesn't know, and maybe didn't even understand what he asked through his thick English accent. So we rang up the state office and they told us what he needed. He'd have to start from scratch basically. Get a learner's permit, provide the appropriate documents and so forth. No problem. We gather all the documentation and go out prepared to get a learner's permit. They gave him a driver's exam and issued him a class C driver's permit. At this point, as we go through this as pretty much every venue, we find it amusing.

Judge ruled the DMV was not liable for issuing a license to a mentally ill patient, but my insurance company was. Got me to wondering why we even have a DMV, they are not liable for anything. But all worked out well, ex divorced me the next morning after that terrible accident because she didn't think I could support her life style anymore. After lots of therapy and paying off all of her debts, actually met my soulmate.

When she came here, did have an international drivers' license, faxed that to my insurance company, they honored it, she could drive my cars with full coverage. Actually dropped my rate, no longer a bachelor going out every night and getting drunk being married again. But not so with that worthless DMV after 13 months waiting for her green card. She was traffic fine and accident free. Would only issue her a learner permit. Did let me help her fill out that form, but sent her to another room to take her written test. Does this sound like the USCIS?

She flunked her drivers' test twice, but still could drive with her international license. Wanted to drive my manual transmission cars, first time she flunked for shifting into second on a wide left turn. Second time, wasn't using hand over hand steering on a fast car that only takes 30 degrees maximum for any turn in town. Finally convinced her to use one of my automatic transmission cars with practice not to take her hands off the wheel, she finally passed. They did issue her a probationary license that expired during her one year extension notice phase with that crazy ROC with a ton of loopholes to get out of it. Said what in the hell is an extension notice, had to fight with the governor and the newly appointed immigration officer that didn't know the first thing about the USCIS. She finally got her eight year license.

As a gun owner with a 14 year old in the house, removed all the firing pins and hid them well, plus locked up the ammunition. But eventually took them both out to firing range, both have a fear of guns, so gave up on that. Especially of those armed guards you find at any USCIS office, both tended to go brain dead. But seem to overcome that fear at the naturalization interviews.

Unfortunately, sounds like this young girl didn't have anyone to guide her, I spent hours studying immigration law and also became severely paranoid doing so. And still wonder why she felt she needed a concealed weapon. Could be her peers had that, another huge problem for a step dad from peers.

ya, forget what i wrote about some affadavit letter,

as

it's likely, probable,

that she renewed the permit many times since first receiving it,

thus claiming many times to be a USCitizen.

One time? is maybe some hope.

Many Times? I think withdraw the application, be happy with a green card.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Gaining closure regarding an issue is nice, but not always possible when people don't return to complete their story.

Because the OP hasn't logged on to VJ since February 2014, this thread is closed to further comments. Should the OP return with an update, he can "report" this thread and get it reopened.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
