I called NVC to talk to them abt me filling my I-864 for my spouse, instead of me seeking advice from her, i end up providing her useful information. I told her i filed jointly with my spouse who is outside the US and this woman was shocked as to how i can file with my wife when she is not in the US and i had to explain to her IRS issues ITIN for the purpose and she was like oh yea okay.

So I guess for those filling jointly with their spouse you might want to include ur spouse ITIN.

Yes and here is the IRS link on who is eligble to file with an ITIN number

Is your spouse here? How were you able to obtain ITIN number for ur spouse if he/she was not here? I think you may be asking for trouble at the embassy if you got the number without your spouse being here. I think that was why the NVC customer representative was shock. As a tax expert, there is more benefit in filing joint tax return especially if one spouse is not working or working but not making enough. I am sure the ITIN information you provided to the NVC representative will be forwarded to the embassy and that can cause trouble. But if your spouse is here then you are ok.

The spouse does not have to have ever been here to file married jointly but they do need to get an ITIN. I got my wife's ITIN in the mail today after sending the paperwork to the IRS about 5 weeks ago. She had to get her passport copy notorized at the embassy.
