On March 12, 2012 we filed our I-129F which went to VSC.

We have patiently waited for this process to finalize, we are still waiting for our NOA2.

Over the past year this is what has happened:

On October 16 we received an RFE because my fiance's visa was not translated into English. I had that resubitted and the response received by USCIS on October 19th. Since then, I have filed two service requestst, and two congressional inquiries. Service requests only push our "normal processing time" out longer (since we have to wait 60 days before we can do anything else) and Congressional inquiries are essentially ignored, e-requests are generic, etc...

We really have nowhere else to go.. I find no one is accountable to finish our application in a timely manner, nor do I see they care.

Does anyone have any recommendations for our next steps?

We employed a lawyer at the start of our process (wish we hadn't - wish we'd found this site first).

However, recently he said to us, when we were complaining about the length of time it was taking for the NOA2:

'Be assured that if ever they violate a statute, such as going over 1 year without approval, then yes I can sue the government and compel them to give a response due to hardship to a U.S. Citizen.'

I don't know precisely what he means but does anyone else know to potentially help to OP?

I am with you with just passing the one year mark last month. the bad news is that I used the ombudsman, senators office and service requests which all failed to develop any information. The best advice that I can suggest that has helped me very much is to find a good immigration lawyer that can make inquires. I did this and shortly after she was making inquiries news started coming in and I recieved an interview from the local office. Worse. You can also have a lawyer submit a mandamus action to force immigration in front of a judge to explain why they are taking so long with your case. This long waiting has been horrible but the end has to be getting close.

Geez res, I thought you would have been done by now..... I guess we're close to being the stragglers of the stragglers. It's pretty depressing when you don't even show up on Igors list anymore....

I have gone the congress route twice.. (Working on the second one now....). Service requests are garbage as well as calling, including "tier 2". I'm sure you know.

Haven't tried the ombudsman, and I was highly discouraged to go for the writ of mandamus.

Grrrrrr.....

This is so depressing. To see people wait for over a year just to START their lives with their significant other. Imagining the ones with infants whom lost a vital year without one parent. I thought this was supposed to reunite families and lovers quicker for our American citizens. What's going on? I hope you guys get your approval soon, I wouldn't mind waiting longer if they did yours before mine. Good luck

While I am one of the ones watching from afar as my little guy grows up (1 year in April), I too would much rather see these ridiculously long cases resolved. I have said it before, but I will say it again: it is inexcusable.

I have been approved by my interviewer and she sent the petition back to CSC five weeks ago. She said it can take up to eight weeks for them to process the approval. While I should be excited I am not holding my breath until I see that dam approval in my hands.

While I am one of the ones watching from afar as my little guy grows up (1 year in April), I too would much rather see these ridiculously long cases resolved. I have said it before, but I will say it again: it is inexcusable.

I really think the fact that there is no reason given is the worst part. But I don't see them changing any time soon. Good luck in your own journey!
