My husband and I live together in Costa Rica and we both traveled up to the USA to get married. At the border we told them we were there to ski, didn't mention the wedding, just in case. After the wedding we came back to Costa Rica as husband and wife, where we are applying for CR1 visa.

Perfectly legal.

My husband and I did exactly the same....I went to the USA for Christmas, got married whilst there on a VWP and I returned home and started the I130 process. Wasn't asked if I intended to marry so didn't say anything about it at POE. Nothing wrong with that as long you don't intend to overstay.

Thanks everyone. I'm going with the more cautious route and marrying her in her home country. I don't want to have to deal with the complexities later on during the interview with the immigration guys. They tend to be not nice people from what I hear.

You realize the same rules apply to EVERY country right?

No one HAS to let you in.

I think some people forget that.

While marrying in another country won't necessarily raise red flags, it still carries the possibility of being denied entry.

You STILL have not disclosed her "home country" so the answers you're given are just speculation.

Would you not prefer a more solid one?
