parent petition for children

Hi this is question for parent - how long does it take these days for Green card parent to sponsor children over 21? Also, god forbids, but if this is taking too long and parent passes away, what will happen to the petition?

Which country are the children located in or which country will they apply for the visas..? The children would be visa class F2B as long as the parent remains a LPR. should the parnt become a citizen that category would change to F1 which is moving faster than the F2B category. The parent/petitioner may request to keep the visa class if it is to their benefit. The case must have been approved at USCIS for a chance of option to open up should the parent/petitioner dies. IF the case was approved then a request maybe filed to continue the case (not guaranteed) and filing the respected forms i.e. the AOS I-864. Some may even say that if some one else could petitioned the future immigrant than have them do so.

What is the home country of your children?

If the petitioner dies, the petition dies with him//her UNLESS you have another LPR/USC relative who can replace and take on the responsibility of the petitioner.

Thailand - it's not my children, it will be my mom's children, which is my sisters and brothers - I am a USC. Does that mean, if something happens, I can replace and take on the responsibility without losing the dates on the petition and start all over again?

Substitute Sponsor

If the visa petitioner has died after approval of the visa petition but U.S. Citizenship and Immigration Services (USCIS) decides to let the petition continue, a substitute sponsor must file a Form I-864 in place of the deceased visa petitioner. In order to be a “substitute sponsor,” you must be related to the intending immigrant in one of the following ways:

Spouse

Parent

Mother-in-law

Father-in-law

Sibling

Child (if at least 18 years of age)

Son

Daughter

Son-in-law

Daughter-in-law

Sister-in-law

Brother-in-law

Grandparent

Grandchild

Legal guardian of the beneficiary

You must also:

Be U.S. citizen or national or a permanent resident

Be at least 18 years of age

Be domiciled (live) in the United States

Meet all of the financial requirements of a sponsor pursuant to INA 213A

The substitute sponsor assumes all of the obligations of an I-864 sponsor.

Yes, you will be the substitute sponsor, provided USCIS/NVC allows the petition to continue.

For Thailand, F2B waiting time is 8 YEARS. The applicants must remain unmarried during the entire process. If they marry, they automatically disqualify themselves from the F2B category.

When your mom becomes USC, she can upgrade the petition to F1. Still, the applicants must remain unmarried during the entire process. If they marry, they automatically disqualify themselves from the F1 category.

You can file i-130 for your siblings at the same time as Mom's i-130 for them. They will be under the F4 category (Brothers and Sisters of Adult U.S. Citizens), Waiting time is 12 YEARS.

The F2B being retained is a 50/50 possibility. USCIS can approve it or not. If they don't let it continue at least you still have a "back-up" plan for your siblings. They can get married during the F4 process if they want to.
