Im divorced now but still my marriage in philippines stil existing...of coursed with the same woman.. We got marry in the philippines and divorced in usa... Now planning to file fiancee visa to my new girl friend .question is....what should i do to my marriage in.phiipines...is this can affect to my petition for fiancee visa to my new girlfren..although im already divorced with.thesame girl...help

+1 to confusing.

You need to be free to marry for the K1, and you need to intend to marry your girlfriend (so, you might want to, like, ask her to marry you...).

* I-130/CR-1 visa by Direct Consular Filing in London
3rd May 2013 - Married in London

7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

Divorce is illegal in PI, so the OP is saying he got married in PI and divorced in the USA. PI will not recognize his US divorce, so he is asking about the rules. This question is a better asked in the PI forum.

I think what you mean is you got married here in the Philippines and also there in the US with the same woman. If you are divorced now in the US I think you need to get an annulment of your marriage here in the Philippines. Good luck! :)

He doesn't need to file for annulment. Philippines will honor the divorce papers done in US. OP should send a copy of it to Philippine NSO.

So if they get married here and got divorced in the US they will honor it here?

Only if he's a USC (which I assume he is). If the OP was a Filipino then he would need an annulment.

My fiancee is anuled but she is still using his ex surname .bec she is working in spain .question is..is there problem if i file fiancee visa for her without changing her docs from married to single..is it ok if she still.use his ex husband surname if im going to file fiancee...whats the best thing to do..

As long as she has the document (with translation) that lists her name change. She's supposed to have that anyway.

No need to change all her documentation back to her maiden name. Just provide a copy of the document that shows her legal name change. I am the USC and when I petitioned for my husband(then fiance) I just added a copy of the certificate from my previous marriage to show why my name was different than the one on my birth certificate. It states to do so in the I-129F instructions. Do not forget to provide a copy of her annulment papers too.

Where did you get divorced? Who petitioned for divorce, you or your ex? If you, was it before or after you became a US citizen?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I think you do need to have your married annulled in PI. If I am not mistaken, you got married in Pi first then it got honored in US.

Try going to the embassy and submit your divorce papers.. If there is such thing as report of of marriage. maybe there is also some policies regarding divorce or annulment... Just maybe...
