Hello guys, First off i want to thank you guys for your help. I hope i am not posting a redundant question.

I am a US citizen filing a I-130 for my spouse in Pakistan. I just filed at the end of January but was wanting to get my documents together for the upcoming NVC process. My question is regarding the I-864 affidavit of support form. My situation is the following:

I was in medical school in 2010, 2011, and up till May of 2012. I therefore did not file a tax return in 2010 or 2011. In 2012, I began my residency and my annual income is ~48k. My Tax return for 2012 shows a gross income of ~22k which is >125% of poverty level for two people. The reason it is only 22k however is because I worked less than half the year in 2012 (residency starts in July).

I plan to use the I-864ez along with my 1040A, W2, a letter from my hospital stating my current position and salary, as well as 6 months of paystubs showing proof of stable income. I will also provide a letter stating that I was a student in 2010 and 2011 and therefore did not file my taxes.

My questions:

1. Should I file backtaxes? According to I-864ez instructions, it only requires one year of tax returns. I came across some mention of it while perusing the site.

2. I am clearly above the financial cutoff for support, do I still need my parents to back me up regarding more support?

3. It states to show evidence of why I did not need to file taxes in 2010 and 2011, how would I show this evidence? Just show my tuition fees for the years or something along those lines?

Anything I may have missed may be very helpful too. or what u would do differently. thank you!

I was trying to edit but I couldn't. Ugh. I also have like 15k in cash (6k in a roth IRA, and the rest in a savings account). Should I consider giving statements for those as well?

I just want to make sure everything is done the right way the first time so i dont have to wait any longer for her!

It's based on your current annual income, not your incomes for the past 3 years, or even your income from the past year. Since you made 22k in less than half of a year, your current annual income is likely to be far higher than that. So I think that you should be okay. Preferably have an employer letter that verifies your income.
