Hi All,

Can I petition for my husbands k2 child even though he still doesn't have his Legal Permanent Residence card? I just put in his papers to Adjust his status. (AOS)

Sorry, your question is a little unclear to me. The child came over on a K-2 visa and now you are wondering about the AOS process for the child?

Hi,

The child is under the follow to join benefits. I got married to my fiance (k1) and his son is still in the Dominican Republic. My question is if I can file for the K2 even though he doesn't have his LPR card yet, because the procedures ask for a copy of the LPR card.

Yes you could! I filed for my step daughter and she's already here. My husband still does not have his GC. He just has his EAD/AP card. And I did not need to send the copy of the card bc we don't have it. You just need his A # which is on all of your papers, including the original I-129 NOA1
