filling 2012 income tax

Timeline

My spouse (Petitioner-USC) just called me that she is filling her income tax for 2012, is she suppose to put single as her marital status since the information required need my SSN (beneficiary), which i dont have for now. We are legally married since april 2012.

please i need response, is urgent plsss...thanks alot

as long as she was married at some point during the tax year , she cannot claim 'single' anymore as that may be seen as tax fraud. she should do married filing separately as the procedure for married filing jointlyj may be long for her to purse. I am in the same boat; married sept 2012 and will be going out today or early next week to do my taxes.

as for SSN , I understamd you can NRA( non resident alien ) in that box.

09/26/2012: Mailed I-130 from Nigeria( delayed by customs)
USCIS stage ( 66 days)
10/12/2012: NOA 1
12/17/2012: NOA 2 (case was transferred to NYC office 11/27/12)
NVC stage ( 20 days)
01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!

Means you are mailing it in. However if you qualify as Married head of household you can do it with a SS# and file electronically also. (I can't no children at home).

If you dont mind me asking? what state does your wife stay in? reason being I just came in few minutes ago from my tax preparer( past 6years). This guy sure knows his stuff and the EXACT SAME thing you mentioned above is what he told me that is why I am wondering where your wife is :blink: . He also stated I cannot file as married filing seperately since we have not lived together for six months, my husband is not here and he does not have a SSN. He also stated we cannot use 'NRA'. He said if i mail it in, IRS will not process my case, instead they will hold unto it and request that incomplete info be submitted. He said I can only file as single and then do amendment later If i want.

He even offered to call a good immigration lawyer that knws tax law so I could hear his opinion too or even IRS. I told him its not that i dnt believe him but that the Consular officer at the embassy may not knw this law he is talking about and may wonder why I claimed being single on my tax document.

At the end we decided to do an extension so at least my hubby could have something to submit for the current tax year then when he comes in we will do married filing jointly.

From what I have just read on the IRS website, it seems you must have either a social security number or an Individual Taxpayer Identification Number (ITIN) to file married whether it be jointly or separately.

If your spouse is a nonresident alien and you file a joint or separate return, your spouse must have either a Social Security Number (SSN) or an Individual Taxpayer Identification Number (ITIN)

You may be able to get a Taxpayer Identification Number from the IRS
