Can I apply for a B1 visa while I am still waiting for a K1 (I am the bene obviously)? I'm not saying I want to apply for a B1 for sure, it's more so just a curious question. I am going to need a waiver for my K1 because I plead guilty to assault occasioning bodily harm in australia over 3 1/2 years ago. I have once applied for a B1 and been denied, the CO told me to reapply in a years time, its been over now so I'm wondering if I'd likely have more luck. My fiance just REALLY wants me to see her country and how she lives and meet her family etc. I can clearly show intent to return to Australia with many things but I'm just wondering if its even possible to apply for 2 visas at once. But I'm guessing even if I applied for a B1 it would be denied however the CO might be more likely to recommend me for one of those d3 waivers... ? Am I on the right track with things here people!? The US is sooooo hard to get into and sadly for me the only reason I really need to go is because the woman I love is from there. Please dont judge me for my conviction, I was an apprentice at the time and I couldn't really afford a lawyer to fight the charge. I did not start the fight, I am not a bad person.

It would be unlikely for you to be granted a D3 visa to see your fiance...with a K1 pending.

You can always apply but with your history, a pending K1, and a B1 denial, prepare for the worse but hope for the best. Visas to the US are never a guarentee

D3 takes about 6 months.
