A few questions: getting married on OPT (F1)

Hello everyone,

Hopefully I am posting this in the right section. After 2+ years of dating, I am ready to get married to my beautiful girlfriend (fiancée? Not used to saying that!). We both graduated from a US college in December 2012 and as a former international student I am currently on OPT (expires end of January 2014). While I understand most requirements to apply for a green card, I just wanted to ask you guys a few questions I have:

1- Being on a F1 visa/OPT, am I right to believe I need to apply for an adjustment of status?

1- How long will the process from full set of form applications sent to actual reception of green card typically take? I have read many contracting reports on the timeframe. If it helps, we are based in Florida.

2- What type of bonafide marriage evidence should we be sending? We've never had anything really officially joint (bank accounts, insurance cards) but obviously have a bazilion pictures of us dating back from 2010 on Facebook, yearly trips taken together in 2011, 2012. We've also been living together for 10 months now, banking statements can prove that we've shared the same address since. Will that suffice?

Adjustment of Status F1 Visa to Conditional Green Card

June 4th, 2013 - Filled for Adjustment of Status (F1 to Green Card).

June 5th, 2013 - USCIS received petition.

June 10th, 2013 - Received USCIS Acceptance Notification via text message and email.

July 10th, 2013 - Biometrics appointment.

August 22nd, 2013 - Received EAD card

July 31st, 2014 - Interview at Miami office - APPROVED

August 22nd, 2014 - Green Card received

Removal of Condition

May 11th, 2016 - Mailed out I-751 application

May 13th, 2016 - USCIS received I-751 application

Timeline

If your intend is to live in the US with your soon-to-be-wife, then yes, filing for AOS is the way to go. You will file based on marriage to a US citizen.

Your wife will have to file the I-130 petition for you.

It's difficult to predict how long the process will take... It can take a few months, as it can be much longer.

K-1 Visa Timeline AOS Timeline

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...

hi newbie,

hopefully you were able to file for AOS and everything is going smooth. I am in a similar situation.

I am on OPT extension (STEM) and I am trying to file for greencard through spouse. I want know what happens to our current status in USA once you file for greencard? Can I keep working on my STEM extension while the employment authorization (EAD) and greencard is awaiting?

I will appreciate if you can share you story and have any pointers for me.
