hey guys,

well, i'm the beneficiary and my wife(petinioner)... ok, we all know that the IRS TAX TRANSCRIPT is the best proof of tax returns compared to the normal tax return.

my question is :

is it mendatory to submit the 2012 IRS transcript now OR we still can use the 2011 one as the most recent year, so the most recent years would be 2009, 2010, 2011. so what do you think guys ?

Note: the IRS transcript is already available for 2012, but when my wife called the NVC the operator told her that the 2011 would still be considered as the most recent year untill july 2013.

so we really got confused, since my wife didn't start to fill her 2012 tax yet :( and we really have to send the AOS to the NVC, because we are really late though.

thank you very much guys for any help

2011 will be ok as the most recent year. People is not obligated to do their taxes early in the year as long as they do it before April 15th.

just for you know guys:

the NVC probabely will accept the 2011 as the most recent year BUT my concern is for the embassy interview, because the consulate officer may ask for the 2012 transcript by the date of the interview which it would be around April ? ... or he wont since 2011 is still acceptable as the most recent year untill the month of jully 2013 ?

... you may tell me that my wife can just fill her 2012 tax, but she can not afford it actually since she didn't even start to process with her 2012 tax yet... so i really hope the 2011 would be fine as the most recent year.

Also want to let people know that 2012 transcripts are available as long as your taxes got accepted already, so if you did your taxes in early February or before that then you can get your 2012 transcript already.

She can simply say that she sent her petition before doing 2012 taxes. The consulate will see the dates...

If you can't change your mind, are you sure you still have one?

This is absolutely 100% completely true. I have copies of my 2010, 2011 and 2012 transcripts at my house with all my other documentation involving my application, so I know for a fact that once you have filed and been accepted, you can order that transcript.

For this particular case, I'd guess that 2011 should be fine, but when you file 2012, I'd order the transcript to have just in case it becomes necessary down the road. It won't hurt to order it and not need it.

Best answer.

Every time we filed and provided tax returns/transcripts, they always asked for the most current tax year when we were interviewed. So, send what you have now, and when the interview happens, have the most current return on hand.

You may want to split or create a new topic as this one is a year old. If he filed his taxes by April 15th there might very well be a transcript available on the IRS's website. Google IRS tax transcript. They're free and can be downloaded as a PDF once you create an account.

If he didn't file his taxes yet you can get proof he filed and had an extension granted assuming he did that. That form will list his expected liability and some other info. Combine that with his W2s for income and any other supporting documents (paychecks) and proofs of income along with the previous year's returns. If he did file get a statement saying he did, on X date and have a copy of that filing as well. My wife was fine with paystubs, W2s, 3 years of transcript, original employment letter and the extension letter since I didn't have her ITIN yet and live in a common property State (where you can't file separately for those so I figured I'd just wait).

Hopefully this helps some.
