What is the 'implied' limit on someone using the VWP?

My boyfriend came here for 2 months earlier in the year, then came back for 3 and the Customs weren't too happy about that (he was just going off what his travel agent said: that it was OK), but let him in anyway. It's now 5 months since he left and was considering coming over here for 4-6 weeks around January before we decide to submit the K-1, do you think they'd let him? Have any of you known others who have 'abused' the system worse in the space of a year?

I can not find any restriction on using the Visa Waiver Program multiple times. I have read before that the CBP tends to prefer seeing 2 months between departure and re-entry. If he has been away for 5 months he should not have problems visiting.

I would recommend having evidence of strong ties back home, like a letter from an employer, or copy of an apartment lease agreement.

I have come to the USA many times to visit my (at the time) boyfriend under the VWP, but always once a year and only for about a week or two at a time. The customs agents might get suspicious, but there is no restriction as far as how many times a person may enter the US under the VWP. However, it helps a bunch if your boyfriend shows strong ties to his homecountry, just as YuandDan posted. I remember them asking me questions about where I worked in my homecountry, and seemed happy to hear that I worked for a well known American company.

My story:

09/23/2002 - Met Chris online, there was something very special about this guy =0)

07/16/2006 - We got married in Reno, Nevada.

USCIS:

08/13/2006 - Filed for AOS, AP, EAD - they were VERY carefully packaged with a detailed cover sheet on top of each of the forms, just as VJ's instructions recommend. It was A LOT of work, but it did pay off! (we firmly believe this is what sped up our process big time)

08/31/2006 - Biometrics appointment

09/09/2006 - Received my AOS appointment date!

10/26/2006 - EAD touched and AP APPROVED!

10/27/2006 - AOS appointment at 7:30 AM! APPROVED IN EXACTLY 70 DAYS!!!

11/01/2006 - EAD approved

11/02/2006 - Email notification - greencard will be mailed as soon as it is ready! YAY again!

11/02/2006 - Welcome to the United States of America letter in the mail! Almost there! =)

11/06/2006 - EAD card and White card (a.k.a. greencard) arrive in the mail!

Journey Total Duration: 80 days

Filed for removal of conditions on 07-28-2008 and had them removed on 09-10-2008

Oct 29th 2004 -Met online
Oct 29th -First phone call
Dec 25th -She purposed and i said Yes!
May 10th I-130 Packet and Packet 3 sent off to me by the U.S. Consulate
May 16th -Received Packets 1-3 from the U.S. consulate
June 29th -I arrived in Puerto-Rico!
July 2nd -Married in Mayaguez, Puerto-Rico and also got our interview date for September 6th
August 17th -We arrived in Australia to file for Sep. 6th
September 6th - Filed DCF in Sydney and approved 1 hour later!
September 12 -Received my passport with the visa and yellow packet
November 24th -POE.......Guam,USA
December 12, 2005-Green Card arrived in the mail
September 11, 2007 -Filed I-751 on conditions
September 17 -VSC Receives my I-751 and issues NOA1
Oct 10 -Had biometrics taken in San Juan, Puerto Rico ASC
Oct 12 -Touched.
Aug 21, 2008 -Approved!...........finally
Sep 17, 2008 -Mailed off N-400
Oct 22, 2008 -Biometrics taken in San Juan ASC
Feb 12, 2009 -N-400 Interview
Feb 26, 2009 -Oath.....the end.

I see you are from Australia - or your BF is - before you begin your K-1 processing, look into the DCF option. It's an easy, and much quicker process available to ppl in a few countires, Australia being one of them.

You have to be married, but if you don't mind jumping the gun on that -it's HEAPS faster :)

Already sounds like it is....

The question is not whether you can get married under VWP, the question is can you adjust status from.....
