This may sound as a dumb question but here it goes. My wife and I finished the K-1 Visa Process, she moved here we got married. We sent out the AOS paper work and are currently waiting on approval. My understanding is that the AOS approval can take quite awhile, and her I-94 is only good for the 90 days. SO.... what happens when the I-94 expires and we are still waiting on the AOS approval??? Is there additional paper work we need to do?? We are also trying to get her driver license which requires some of this information.

Any help is appreciated! Thanks!

She is in a period of authorized stay when you get the NOA 1.

Most places require the green card or the EAD card to get a driver license and other items.

If the I-94 is still valid then in some states you can use that to get an SSN and driver license if your fast. But if its close to expiration many places will not accept it.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Nothing to do, just wait. Her I-94 will expire but she filed for AOS so she is in a new period of authorized stay. Her status is something like "AOS pending".

K-1 Visa Timeline AOS Timeline

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...

Yeah DIDOPAGE is right! Nothing to do just wait! After the i94 expires, if she already has her AoS's NOA1 she is more than fine BUT she will need to wait to get at least her EAD to get her drivers license and SSN. In my case, I went to the Social Security Office 5 weeks BEFORE my i94 expired and the ssc staff told me he cannot process my ssn cause it was about to expire (5 weeks before :/) so I needed to wait.
