Green Card for wife and moving abroad

Good morning all,

I happen to be in a bit of a predicament since at the movement I am processing my fiancée I-129f visa.

However, this week I've been told about a potential job offer and a possible acceptance into a graduate school abroad in my fiancée's country of origin. (Latin America)

Given that these possible opportunities could be months away from materializing, I could only wonder about what to do.

Could we continue on with the process (K1 visa), get married in the US and then have her petition for her green card and once she receives leave the US using my not so valid excuse?

Or should I just withdraw her I-129f application and then once we are ready to migrate back to the US file for a spouse visa?

WOW!

You are basically asking should I file for her now or postpone it to sometime in the future and go with school/Job. It is different from asking " which, is faster or cheaper ; K-1 or get married and do Cr-1"?

This is something both of you need to sit down and discuss your best possible options. Vjers might tell you go with your opportunities now but what if she wants to move on with the relanship instead or vice-versa ?

NVC stage ( 20 days)
01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!
05/13/2013: POE; JFK

IR-5 for Mom Entire process took 5 months exactly

NVC Case COMPLETED: 2011-12-07 ( 43 days from NOA 2 and 65 days from NOA 1)
Interview Date(Lagos): 2012-01- 23
Mom was late for interview
New Interview date: 2012-02-29 : VISA APPROVED

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

We are getting married nonetheless however, in light of recent events I do not know if we could leave the US once she receives her PRC?

I submitted her application in January.

If I take the job / school I could start as soon as September but they seem willing to wait a bit longer.

You may just about get the K1 interview done by September (maybe!), but then she'd need to come over and you get married and then file for AOS and AP. Even with an extra month or two, that would be a very tight timeline.

It sucks to loose the petition fee but I would withdraw the K1, get married in her home country and then file for the CR-1 spousal visa when you are almost ready to return top the USA (assuming you WANT to take the job), that will safe you the AOS fee you'd need for the K1 too. If you are married over 2 years by the time you return, she will get the IR-1 visa and a ten year greencard upon entry, which will save more money by not having to do Removal of Conditions after two years.

Is she from Mexico? If so, you can file DCF (directly with the embassy) when the time comes, and it'll be fairly quick.

No, if she can get into the USA with a tourist visa then she can get married there, that is perfectly fine as long as she doesn't overstay.
