So we had our AOS interview today, we hired a lawyer because my husband recently received a ticket for furnishing alcohol to a minor, his court day is not till next month so he hasn't ben convicted or charged with any crimes yet. he was never arrested either . he only got a ticket and a court citation. now at the interview the IO only asked a few questions from form I485 he only asked him if has ever been involved in terrorist activities, if he has ever been arrested or convicted of a crime. my husband said no. we were waiting for the IO to ask if he has ever been cited etc. but he never did. he approved our aos really quick.... should we be concerned ? we dont want them to think we are lying. Even my lawyer said she never heard he question. what are your thoughts on this :( ?

He has to make his appearance in court and that is in the future. So when you husband answered, he was truthful since he wasn't charged with anything as yet.

He has to make his appearance in court and that is in the future. So when you husband answered, he was truthful since he wasn't charged with anything as yet.

That's what we thought too! I really hope they don't think we're lying. thank you ! :)

On page 3 of the form, there is the question- Have you EVER

b. Been arrested, cited, charged, indicted, convicted, fined, or imprisoned for breaking or violating any law

I would think that means they want to know, whether the interviewer said all the exact words or not. An interview allows you to update anything on your application that has changed since you mailed it. It will be asked of you again if you apply for citizenship, so be sure and keep all copies of settlement, fines, etc from the court.

the irony of my situation is this. Before I submitted my i-485 and i-131, I did my own personal FBI background check at my Lawyers behest, it took about 2 months and when it came back I was considered to have no criminal background. My Lawyer though, once I had told him I had a DUI in 2000, in Baltimore, and a disorderly conduct citation in 2006, he insisted I submit original court dispositions with my application. Go figure, I chose the only honest lawyer in NYC. lol, however, this proved to me how good he is. Anyways, I went ahead and got these documents and submitted with my application. I had my interview yesterday, and the IO asked me about these arrests. I was honest, explained myself well and it was a small issue. However, nothing was a felony and my case was approved. Be honest, and you will be fine.

We were honest , he gave us the paper to sign (to remove conditions in 2 years ) before he started with the interview. what can I do at this point? my lawyer just said we need to take care of the ticket.. I checked online and the card production has started. should i contact the USCIS and let them know? We dont want to get in trouble! :(

Honesty is an opinion. You must have had doubts or you wouldn't have asked. You were wanting opinions so I gave mine because I had a different one from Smiley. He said hubby wasn't charged with anything. I disagree. He was charged with furnishing alcohol to a minor. He has not been convicted yet. It's water under the bridge now and likely wouldnt have resulted in a denial had you updated your answer to that form question. I have no opinion on what you should do. It will resurface if you apply for citizenship in three years, so save every paper, ticket, receipt from anything...even traffic tickets. Some naturalization interviewers insist on more than others. A guy from the UK had to get documents from when he was a young teen in England. My husband reported a traffic ticket and offered receipt of payment and his interviewer filed it and made a note. It was from before his greencard. Others interviewers say "that's fine" if it's only a speeding ticket. Just offering a heads up to save paperwork.

Honesty is an opinion. You must have had doubts or you wouldn't have asked. You were wanting opinions so I gave mine because I had a different one from Smiley. Thanks for your answer, I really appreciate it, my lawyer just called me saying that she feels really bad because she ''didn't catch the question'' and this was her first i485 interview. she's sending the USCIS a letter. She wants us to order a police clearance letter (from England) to show that my husband haves a clean record back home. I think I feel a little bit better now that shes going to try and sort this out, I really don't want them to think we lied ! I will let you know what happens, thank you and have a great day :star:

Hi pls help me out..I also had a shoplift case which I got a disposition for...I soo scared to go for interview alone since I had a previous marriage which was denied...pls advice me on how u got things sorted out with the charges...is it worth it to go wit a lawyer?

Hi Rocky,

I'm not sure how I can help you out. When you are dealing with an arrest, I would always advise the use of a lawyer. I ended up paying 4k$ for mine, but it was worth every penny. His assistant must have hated me by the time my interview was over, lol, I was calling every day with new questions and worries. In the actual interview, my lawyer knew the IO and they greeted each other warmly. As I mentioned, I went to the court house for each arrest, DUI was 13 years ago and disord conduct was 7 years ago, I got original certified dispositions, and simply told the IO what happened in each arrest. They will ask you, as it's on the i-485 you submit. Try not to stress to much about it, nothing you can do really except be honest and pray to God that the IO doesn't consider shoplifting to be a crime of moral turpitude. Excuse my ignorance, but why are you going alone? How are you adjusting your status? You have been denied already? That might be a problem, I would highly advise you to seek the help of a professional immigration lawyer.

Personally, I would not contact them. You have a conditional GC like me, when you apply again to have the conditions removed, then you will most likely have to deal with this. It wouldn't hurt to get all the paperwork sorted now, in terms of the disposition. Then when 2 years roles around, im told it goes fast ( lol ), you won't have to stress about this. I am by no means experienced in all this, but from my situation I gather that as long as you or hubbby hasn't been convicted for a sentence that carries more then a 1000$ fine or 2yrs imprisonment, then you are fine. A crime of moral turpitude is another factor, as the definition of that is ambiguous at best.
