I will be filing I130 for my mom and step dad..what are the requirements that i should send together with the form?

First, you can petition for your parent and/or stepparent and siblings if you are a U.S. citizen over the age of 21. Second, you can only petition for your stepfather, if the stepparent relationship was created prior to your 18th birthday. This will require proof that your mother and stepfather married before you turned 18 years of age. This can be accomplished by submitting your birth certificate and proof of marriage. If your parents did not marry before you turned 18, then you could still petition for your mother and once she was a lawful permanent resident, she could petition for her husband.

Petition is filed to bring your step-parent to live in the United States

A Form I-130

A copy of your birth certificate showing the names of your birth parents

A copy of the civil marriage certificate of your birth parent to your step-parent showing that the marriage occurred before your 18th birthday

A copy of any divorce decrees, death certificates, or annulment decrees to show that any previous marriage entered into by your natural or step-parent ended legally

Mother lives outside the United States

A Form I-130

A copy of your birth certificate showing your name and your mother’s name

A copy of your Certificate of Naturalization or U.S. passport if you were not born in the United States

Thank you for a quick reply..yes im USC and over 21..my mom and stepdad were married when i was 8..how long is the process to get them..do i need a copy of their passport?

You're welcome! The process will pretty much take up to a year. In my case I waited 7 months for the approval at CSC. You will need to send a copy of their passports( biographical page) during the NVC stage. That will be after you get the approval. Best of Luck! :)
