Nope. Pretty sure you need to show you're changing status (I.e. married to USC so doing AOS) to be allowed to get the work permit.

Theoretically you could, but you would have to pay the fee and wait for it to arrive (~2 month). Your EAD would then expire when your i94 does, and you would still have to reapply following AOS. Just get married and apply for AOS + EAD (+AP) asap, so you can start working as soon as you get your permit without additional cost/bureaucracy.

Yes, you could apply for an EAD NOW, paying the fee.

Historically, an EAD card shows up about 3 weeks before yer I-94 expires,

so you'd have about 3 weeks of work.

Otherwise, wei - apply for EAD with the I-485 application, la. Fee is waived.

Yes, you can but you pay the full fee and then it expires when your I-94, which was placed into your passport at POE (90 days after entry).

So what's the point?

You can get it ready now and mail it in the moment you step off the plane, head for a mailbox and DO IT!!!!!!!!!!

It will cost you $340. You will wait 60-90 days for the EAD and it will EXPIRE with your I-94 90 days after you arrive. Your EAD will arrive about 2 weeks before it expires and then you have to wait for the green card anyway because you cannot apply for 2 EADs. Any job you obtained, you would have to QUIT when your EAD expires.

There is a REASON people say to WAIT until you are married and adjust status

When you say EAD fee is waived is this because its was paid for at first arrival?

No, the fee is waived if the EAD (I-765) application is sent in the AOS (I-485) application, refer to the VJ AOS guide for details:

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

Thank you. Went to the guides after posting the question. Also read the actual instructions on USCIS site where it states the fees do not apply when applying for I-485. So excited, I thought the additional fee's applied. We are still waiting for our petition to get approved. Just familiarizing myself ahead of time. This process is very detailed and overwhelming at times. Thank you again A&B

No problema.

Yes, it can seem daunting at times.

When we applied for AOS, we also applied for EAD and AP. It is all the same (exorbitant) price, $1070 ! :o Follow the Guides, they are right-on.

Good luck and Happy trails.....
