3 weeks ago sveta went to get a state id ( no drivers permit ) only so when we go out she not have to carry her passport as we know passports are not always easy for others to read or carry as she not always carry her purse as everything we go out for lunch/dinner she gets carded for some reason the ID card was denied would this affect her aos, ap? few minutes after being denied we called uscis from parking lot at first the officer agreed and not understand why till he went to a supervisor and still not able give reason but maybe to soon after file aos and has not got to local government/state levels

It will not affect her AOS. Presumably the state ID denial was based on the fact she does not have all the papers required to satisfy your state of her legal status in the US. The same rules apply for DLs so don't be alarmed or surprised.

My wife and stepson were able to obtain their WA-state ID cards approximately two months prior to receipt of their 2-year conditional GCs. Prior to going the DOL office, I merely did some research on the WA DOL website, reviewing the documentation necessary for each of them to obtain ID cards. It was a walk in the park, after doing some of the stuff necessary for these immigration processes.

For the wife (K-1), the certified marriage license was crucial. For the stepson (K-2), certified/translated school transcripts (Chinese "White Books"), with attached photo and DOB were quite useful. For both of them, their current foreign passports, with valid Form I-94, certified/translated birth certificates (Chinese "White Books") were required. Their applications were initially denied, it took a formal meeting with a state licensing examiner to sort things out. After approval, they were then able to pay the fee, and get photographed. The ID cards showed up in the mail in about two weeks. I believe that the requirements are a little different from state-to-state.

i did also check state site and had everything then some even the officer could not understand guess texas rules are different and they request gc then again texas has tons of illegals coming across boarder then again I would think dhs would like this as would show proof where to find the people then them hiding just my thought

Curious since I live in WA-state too. When you applied for the ID card, did your wife have AP/EAD already? What reason did they give for the original denial and what made them change it?

have her try again, when the green card is in her hand.

Sometimes, having the EAD is enough - but it depends on who's at the front desk, aye?

funny just today got letter from state department approving the state is as dhs has provided sveta is here legally

COOL ! So now what? You need to get back to the DMV office and re-apply?

State IDs are not an immigration issue in any way. Her passport has her birthdate on it in both English and Ukrainian and is valid ID, so is her Visa.

USCIS cannot give you a reason because it is none of their business. USCIS does not report anything to state authorities. YOU do that. When she gets her green card or EAD, then go back and get her state ID

first off dhs does inform the states about if someone is legal or not and as I had stated before sveta does not always carry her purse and her passport is MUCH larger then an state id and as you will read dhs has proven to texas sveta is legal and she can receive her state ID

Curious since I live in WA-state too. When you applied for the ID card, did your wife have AP/EAD already? What reason did they give for the original denial and what made them change it?

No, when they first applied this was prior to either of them receiving AP/EAD combo cards. If I were to guess, they (WA DOL) initially deny the ID application as a regular course of action, then it forces the applicant(s) to prove via the official meeting with the licensing examiner to demonstrate the legitimacy of their documents and applications.

Go to the WA state DOL website, and carefully compare what documents you have versus the "A" and "B" list of required documents that are listed. We went to the examiner appointment loaded with the necessary documents, as previously described ("A" and "B" lists), per the DOL website, and presented our cases. The wife's case (K-1) was pretty cut and dry, the step-son's case (K-2) took a little extra effort. But the end results were favorable.

fyi all dps approved the state ID per DHS notified them was here in legal status however the ID is only good till march 17th as this when her i-94 expires huge waste of time not sure if calling dps and explain still here legal on pending 485. think would help?

Most and all states are moving to the same requirement. My wife's DL expired when her I94 did, then when her I797 expired, then the first green card, then on her letter for ROC. Each state and especially border states with issues TX, AZ are getting particular. In AZ they scan in your government USCIS stuff so it is accessible to LE. Like AB said be persistent.

It was granted based on her I-94, therefore it expires when the I-94 does. You could have just waited for her EAD or green card. If you use the EAD, it will expire when the EAD does, in one year. The green card will get her the longest, non-temporary state ID. Here in FL my husband got a temporary state ID with his EAD, then went back and got a non-temporary one when he received his green card. Just had to pay the renewal cost and not pay again the full price for a new ID.

What DOES help is showing up with the EAD in hand.
