Timeline

I am an American citizen, my fiance, Andrew, is English and we have just recently sent off our I-129F Petition for him to come to America and get married.

Andrew has just been offered a job in England with a one year contract beginning in September. Although it is only in the early stage, we were wondering if we are able to postpone the application. Is this possible? We have already paid the full amount so we don't want to cancel and reapply, however we are afraid that the visa may expire before he can enter the US once it is issued.

Any advice is helpful!

You may not need to, depending how far along you are. You'll have 6months from the issuing of the visa to use it, so if you've only just submitted, you may be able to time the entry to be at the end of his year working in the UK, since it takes about 9 months start to finish to actually get the visa in-hand. I guess it also depends how strict his desire is to do the whole years contract, in balance with the cost and time of resubmission.

If you fill out your timeline you can get an estimation for when your petition may be approved to help you work out what might be best.

Right, I just did my timeline. The estimated date for receiving a K1 is August 17th 2013. This is what we were expecting, but he wouldn't be able to come until about August of 2014. I was thinking that we might not need to postpone, if for example we get an RFE. But I think it's too much of a difference.

Yeah, well, I don't think you can postpone, but you can certainly be slow :) I'm not sure how long, for example, London will allow an interview for the visa to be done in after they receive the paperwork and wait for stuff from your other half. Work out your fastest case scenario and longest and see what the deficit gap is to Sept 2014.

You should be able to get it done in the right time for you- just take your time sending in documents, and then when it comes to interview, London is pretty flexible so just ask for an interview a few months later, then you have 6 months to use the visa once issued.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

As others have said take your time when sending back paper work. Also you coule move your interview back when you get to the interview stage, also once issues he will have 6 months to travel to the USA.

Also it may take longer then you think to get NOA2, Sods law though if you get your NOA2 faster then grease lightning.

Oh, I just looked at your timeline and I think you might have filled it out wrong? You've set a service centre (Vermont) which means you must have got an NOA1 to know where it went - you should put that date into the I-129F NOA1 field (the one listed on the physical paper notice) and the date you actually put it into the mail into the other field you've got the date in.

You've set a service centre (Vermont) which means you must have got an NOA1 to know where it went - you should put that date into the I-129F NOA1 field (the one listed on the physical paper notice) and the date you actually put it into the mail into the other field (I-129F Sent).
