If he didn't break any laws, then why was he deported? People who obey US immigration laws do not get deported. Only those who break the laws get deported. Overstaying is breaking the law.

Didn't he live here for over a year illegally? Isn't that breaking US immigration laws?

Why he was deported ? To make it short , he was deported on the basis of " Doubts ".

Well its a long debate that : why people who obey US immigration laws do not get deported? and i'm sure you ill lose ( no offense though ) .

Anyway im not here to make arguments , just need some suggestions how to repair this case and recently my uncle just told us to hire a good lawyer ,lets see.

He will have a ban for the illegal presence

And one for the deportation.

He has not qualifying relative to file a waiver.

So he waits until the bans expire.

My uncle talked to a lawyer( His Friend ) in USA , he said that you have to bear all the expenses and still there is 50 50 chance.However others are saying you must file your case you have a strong chances.

I am still confused whether we should go for it or not.

You are no understanding the question being asked, why should your father be given a wavier, based on hardship. Your uncle doesn't qualify as the relative. What is the hardship that the USC would endore if your faher is never given a visa to re-enter the US?

Dear like i said I'm not applying for the wavier.I know we are not qualified for the wavier app. We will hire the lawyer in-order to legalize the stay at USA.

Ohh dear.

I guess the worst that can happen is getting scammed by an unscruplous lawyer.
